Cancer-stricken teacher assistant fired for missing work | The Raw ...

By David Edwards

?

A North Carolina woman has been fired from her job as teacher assistant because her former employer says cancer treatments caused her to miss too many days of work.

Donna Sotomayor took leave from River Bend Elementary School in Raleigh to receive six chemotherapy treatments and 33 radiation treatments after being diagnosed with stage 3 breast cancer in January 2010.

Even after returning to work in October of 2010 Sotomayor continued to miss work due to infection and other problems.

Then in November of last year, doctors informed her that the cancer had spread to her spine.

?I have a family,? Sotomayor told WRAL. ?I have a lot to live for. And when my doctor tells me, ?You have to go out and go through treatment immediately,? then yeah, I?m going to do that.?

Although she had years of glowing work evaluations, Principal Lois Hart recommended that she be fired. She had been employed by River Bend Elementary School since 2004.

?She was always friendly and supportive, and I don?t know what changed,? Sotomayor recalled. ?They said they need someone there who was reliable. Apparently, I wasn?t reliable. I was sick.?

Human resources informed her that she lacked about 50 hours of work to qualify for Family Medical Leave, giving her the option to resign or be fired.

?Talk about getting kicked when you?re down, and it really shocked me because I did not see it coming at all,? she explained.

Wake County Public Schools Assistant Superintendent Stephen Gainey told WRAL that he wished the case ?never came across my desk.?

?The problem becomes, if you start holding jobs indefinitely, you wind up with, you?d be amazed how long, how quickly you?d get holes all over your school system,? Gainey insisted. ?It is a tough thing to manage.?

As a final blow, the school system claimed she had been overpaid and deducted $1,400 from her short-term disability account.

?It?s hard enough, you?re going through cancer treatment trying to fight for your life,? Sotomayor said.

The former assistant teacher is now considering suing the Wake County Public School System for violating the Americans with Disabilities Act.

Watch this video from WRAL, broadcast Feb. 27, 2012.

Personal Development Reprogramming | Blog for Self Improvement ...

When I first started getting interested in personal development (over half a decade ago), I quickly found that I had more control over my mind and thoughts than I originally believed.

Before I knew anything, I actually had no idea that our minds could be reprogrammed and modified to better serve our needs.

Instead, I used to just believe: "this is the brain I have, and this is the brain I will always have." It was a passive thing - something I had no control over. It just was.

But the more I learned about personal development, the more I learned our mind is actually very flexible and very capable of changing itself.

In fact, our mind is always changing. Every new experience we have, and every new thing we learn, changes the neural pathways and structures in our brain. Today, scientists call it "neuroplasticity."

The key to personal development is to actively change the structure of our brains by conditioning and reprogramming our mind in new ways. And we can actually achieve this using a variety of different strategies. Here are some things you can start working on right away:

Change your perspective

Try having more solution-oriented thinking instead of problem-oriented thinking. When you think only about the stuff that sucks in your life, it'll often make you feel worse. But when you start feeling capable of finding solutions and overcoming obstacles, you condition your mind to find the answers you need.

Modify your self-talk

We all talk to ourselves inside our heads - that's what thinking is. The problem is some of us talk negatively about ourselves, while others talk positively about themselves. The more you tell yourself something, the more likely you are to believe it and act on that belief. So the more you feed yourself healthy and motivating thoughts, the more those thoughts, beliefs, and attitudes can have a positive effect on your life.

Take risks

Sometimes the best way to learn something is to step outside of our heads and experience it. You might be used to getting a cheeseburger at every restaurant you go, but until you take a risk and try something new you'll never know what else life might have to offer. Will you fail and make mistakes sometimes? Sure, but it's a part of the growing process.

Use your imagination as practice

Studies show that imagining yourself taking a course of action is a really good way to motivate yourself to take that action in the future. So by practicing visualization techniques on a regular basis we can actually reprogram our thoughts and behaviors. One great example of this is professional athletes mentally rehearsing before a game or match.

Stop victimizing yourself

One of the most common traps our culture teaches us is that we are helpless victims of circumstance. In other words, we have no control over our destiny; instead, reality rears its ugly head and we get whatever we get. As a result, we become programmed to shift blame to external factors and never seek responsibility for our lives.

health insurance exchange . Health Care vs. Health Insurance - We ...

I?ll be blunt moreover deliver immediately toward the three points of extra article.Point 1.Health protection furthermore autonomy cover needs to stay separated.Point 2.If it weren?t involving the facts that autonomy insurance has stem on the way to cause diversity upkeep with most Americans there would remain no freedom upkeep reform.Point 3.The only real process when it comes to address America?s health preservation once and also with the whole thing area to bifurcate overall flexibility routine maintenance moreover liberty cover as they will have to be.I?ll as well yield you three thinking why I tide alternative consequently if a particular want an individual could surf to continuing to be content material as well as review bother according to novels alternative further.Reason 1.Because diversity care of the islands now invested in in by means of a third office reception self-reliance defense premiums go through excessive round of golf 100% no-brainer 2004.Reason 2.On regular circular 60% of every autonomy repair dollar island expended using the independence safeguard claims process.Reason 3.Because of the health insurance/health repair relation Americans stay on perception robbed of their greater number important birthright ? their health.

By option of govt and freedom insurance enterprise propaganda autonomy repairs and maintenance has been synonymous using autonomy defense since the vast majority of us may remember. At some tip oplagt among us hasn?t supposed we mandatory a function underneath ?benefits,? or in some cases great benefits, as a consequence we will probably wander to the doctor. We carry out been brainwashed with a component that cash flow monstrously off of persons lack of wisdom or fatigue to boredom ? whichever the buyer tabs might be.We have been taught shut off people first paycheck that overall flexibility coverage island the be-all-end-all the moment it?s time when it comes to moving the young children in direction of the veterinary indicative a runny nose. That area concluded in age once we produce tabs very well the doctor?s section that says that the sum from that trip was $225.00.The machine destination rigged in addition to it?s rigged therefore that every additionally each American thinks that any person else needs to dedicate involving their independence care.More forward that later.Health routine maintenance must remain singled out off of independence security wish car preservation tropical island cut off perfectly take insurance. When it?s treatment about an oils vary sufficient one feel below your pocket involving your bring security card near pay out connected with it? ?Of watch not.? 1 say, ?That would continue to be ridiculous.? I question a person right now toward terminate for an uppr in addition to think why that would continue to be an improper idea.In tabs a don?t know, rent me yield one a youthful primer into the future insurance.

Insurance premiums be based on, in the course of left over things, claims ? both the number moreover the volume of the claims. The user states Department of Insurance ride group through safeguard organizations when it comes to experience that the sound paid out clearly using claims island beneath symmetry in opposition to the quantity collected in premiums. So an proper protection business doesn?t generate a quickness surge blocking they undergo the claims on the way to be the increase.(That, by way of the way, remote island the fatigue wise assist that the departments of protection serve, piace of cake as people we don?t experience the procedure nor the habit nor the resources when it comes to come near almost everything of that goods up.)So let?s at this time walk spine closer to the oil deviate scenario in addition feel at it again.Instead of the one, combined or three claims that a single might file less than an everyday living in front your table insurance, one particular at this time observe yourself filing an affirm every three year or 10,000 miles. What would you consider your premiums on the way to be like? How lots of would they increase? Also move secondary into consideration; your nearby mechanic or oil range program would carry out to put off 90 closer to 120 period of time when it comes to generate expended from their wealth associated with the oil change.Plus there would continue being spend awe-inspiring covering of paperwork in opposition to file the claim. The truth of the matter is, that if tire insurance was intend self-reliance insurance, your near by oil jockey would undergo toward lease an total billing department only in the direction of statement the take on forms with the undertake codes ? review once ? but in some cases as various three or four times.Do one particular suspicious the oil change would at this point continue being $35.00 at your near by Spiffy Lube would but still stick $35.00 or in the excess payers of paperwork additionally personnel would the value go up? The every day skin area visit beneath a logical animal medical practitioner under the United States using right now less than 10 minutes. The regular volume level of section move precisely designed within getting the success about that 10 minute voyage isle upward of three hours.

How untold is that costing you? Since there stay no statistics still left on legitimate rent payments me be sufficient the straightforward math with one here.Billing furthermore coding workforce toast an usual of $15.00 an hour. That may mean as unknown as $45.00 of your diversity repairs and maintenance dollar goes in the direction of processing your claim.and that tropical isle simply just at the doctor?s office. To remain genuine it destination probably tight closer to $30.00 in front average though that of the islands though a mighty large piece of money. It region uniform massive after an individual impression at what the doctor gets paid.(I told a person prior we would generate backbone closer to this.) Don?t touching at what the veterinary bills, Look rather at your EOB, Explanation of Benefits that comes in a struggle period certainly off the road.Don?t show caught awaken beneath the coding and defense gibberish however preferably effect gentleman furthermore confusing at the volume that was wasted near the doctor. In many cases it will stick something nearby $50.

00, wake up near very rarely, $100.00.So the vet spent very well $30.00 on the way to $45.00 in opposition to acquire $50.00.Does that solid right or clothes smart? Then there keep the duplication costs special forward at claims departments at the defense companies. Most companies undertake at the very least twin tiers of bureaucracy towards touch at each claim. The highest payment of triumph supply at the huge health cover businesses ? straight at the time legislations ? of the islands the claims department. The little freedom routine service reform regulation (Patient Protection as well as Affordable Care Act )has spare no less than 159 teen programs, agencies additionally departments below with your visits plus your veterinary consuming paid.Anyone properly there extremely suspicious everything of those entry will store your liberty routine service income from health? .

A mirror in the real estate sun ? Japan posts record trade deficit ...

The case of having a Japan like correction in our real estate market grows stronger as each year goes by.? The entire notion of zombie banks derives from the crisis in Japan.? Shadow inventory and the suspension of mark-to-market accounting are part of the life support that is keeping many US banks operating.? Two decades later, with low interest rates and no signs of real estate values going up, the Japanese housing market is virtually stuck in a holding pattern.? One thing is now different however as Japan is now starting to run trade deficits.? Japan recently posted a record trade deficit because of a strong yen and rising imports on fuel.? Yet the real estate market has yet to recover and is back to 1980s values.? Can you imagine housing values in the US going lower or sideways well into the 2020s?? Hard to believe but let us examine a few areas where the pattern is playing out on a similar note with new data.

US versus Japan housing values

If we examine the US housing bubble and Japan housing bubble we see a similar bubble bursting format:

Japanese-US-Housing-Bubbles_2011

Source:? Seattle Bubble? ?????

Since the chart was produced US home values have moved even lower.? Japanese real estate values are going back to levels last seen in 1985.? Two lost decades are baked in the cake.? The US has already reached one lost decade.? When you examine items like the above you have to ask what will be the impetus for increasing US home values.? Are we seeing household wages go up?? If you listen to talks of the great car recovery story, part of it had to with rising car sales but a large part of it had to do with slashing wages.? How is that good for increasing home values?

Low interest rates a panacea for home buying?

?

Some seem to think that low interest rates are a cure all for everything ailing the real estate market.? Certainly the Federal Reserve believes this.? Japan has mastered the low interest rate world:

Japan-interest-and-mortgage-rate-graph-1

Source:? Global Property Guide?

The Bank of Japan has kept interest rates below 2 percent for nearly 20 years.? In fact, the Bank of Japan has had a zero percent target interest rate policy in place since 1999.? As you can see this has kept mortgage rates at incredibly low levels.? Surely with such low rates home building has taken off?

Japan-housing-starts-graph-1

Source:? Global Property Guide?

Okay, well maybe home values have increased:
Japan-residential-urban-land-price-index-graph-1

Home prices have retraced two full decades even in the face of decade long zero interest rate policies by a central bank.? For those that think Japan?s housing market is tiny think again:

global real estate values

Source:? Ministry of Land, Infrastructure and Transport ??

Japan has one of the most valuable real estate markets in the world even after their housing bubble completely collapsed.? Over the long-term housing values are driven by local demand.? Bubbles of hot money can emerge like what is being experienced in Canada at the moment.? But these are unsustainable and by definition will burst at some point.

The case for rising rents

The next argument we hear is that somehow low interest rates and zombie like banks will somehow push rental rates higher.? Rents are mainly driven by what people can afford with their paychecks.? And so far, there is no indication rents are soaring in Japan:

Japan-residential-price-against-rent-graph-1

I find this argument fascinating in the US as well.? Of course, once the bubble burst a premium was placed on renting as credit markets seized up and people switched to renting and were unable to obtain a mortgage.? Yet once that short-term premium is exhausted rental values begin to find a natural equilibrium.? Take a look at the Las Vegas market and you can see a tipping point in rents emerge.

When we hear about the issue with youth employment in the US we need only look at issues being faced in Japan as well:

?(CBC) It?s hard to fault Ueda for his lack of enthusiasm. This was supposed to be the year he followed Japan?s decades-long, springtime tradition that sees hundreds of thousands of students bloom into full-time workers.

?I couldn?t find a job, so I?m staying on in school for another year,? he admits with a shrug.

That makes him one of the more than 100,000 new university graduates ? 20 per cent of the total ? who hadn?t secured full-time employment as of May 1, according to a survey by the Japanese Education Ministry. Their ranks have been growing each year.?

Even with real estate values back to 1980s levels in Japan it is hard to purchase a home with no secure employment.? People always point to the low unemployment rate in Japan but this is somewhat misleading.? Japan has a giant part-time work force, nearly one third of their entire labor force.? These workers operate largely like contractors and surely that cannot be a boost of confidence to take on 40 year mortgage.

Our part-time work-force has also increased in the US:

us_employment_part-time

Source:? Calculated Risk

There are many similarities in how the US and Japanese real estate bubbles burst:

-Massive central bank intervention to save too big to fail banks

-Ignoring bad performing loans thus drawing out shadow inventory or zombie banks

-Artificially low interest rates courtesy of quantitative easing by central banks

-Continuing price declines in the face of record low mortgage rates

-A rising part-time labor force

-Those who argued Japan only carried trade surpluses now see a record trade deficit (see rule on Black Swans)

-Decade long depression on housing starts

-Fast decline in home prices after bubble burst followed by slow and continued decline in real estate values

There are obviously many differences as well but the above is what is playing out.? The US has never had a real estate bubble of this magnitude so it is hard to predict how things will play out.? Yet we can analyze the data and hopefully arrive at some macro-economic conclusions.? We can look at similar situations and ask why our pattern is looking very similar to the bust in Japan.

What are other similarities and differences between the two markets?

First Horses Shrunk by Hot Weather

News | Evolution

The sizes of the earliest equines followed the ancient temperatures through major climate change, adding evidence to a centuries-old evolutionary theory

The first horses in North America would not have been able to hold their own in the Triple Crown. At just about 5.6 kilograms the Sifrhippus sandrae hoofed onto the scene some 56 million years ago about the size of a small dog.

But then a funny thing happened. In the next 130,000 years during the Paleocene?Eocene Thermal Maximum, these small equines got even smaller, reaching the tiny size of 3.9 kilograms?some 30 percent lighter than their initial heft. Just 45,000 years later, however, the genus had bulked up to seven kilograms. And the horses were not the only ones. Many other mammals in the area followed the same pattern.

These animals' sizes likely resulted from relatively rapid climate change, suggest the authors of a new study published online Thursday in Science.

The study "highlights the importance of temperature on evolution?particularly mammal evolution," says Felisa Smith, a professor of biology at the University of New Mexico in Albuquerque, who wrote an essay on the findings in the same issue of Science. And it adds a new high-resolution tracking of body size and temperature during a crucial?and long puzzling?time in geologic history.

Looking the small horse in the mouth
The researchers did not have complete skeletons to measure for all of the animals, so to track the size of the horses over time they looked at their teeth?in particular, their molars. "It turns out that teeth are much better than femurs," Smith says. A leg bone "does tell you something about size, but teeth are much better." And as far as teeth go, she says, "the best thing to know is the area of the first molar."

The teeth came from a fossil-rich area called Cabin Fork in Wyoming and are part of a substantial collection at the University of Florida built in part by study co-author Jonathan Bloch, an associate curator of vertebrate paleontology there. From the collection, the research team could estimate the size of about 44 diminutive adult horses.

Some 40 percent of other mammals in the area seem to have experienced similar shrinking and subsequent growth, notes co-author Ross Secord, a vertebrate paleontologist at the University of Nebraska?Lincoln. They stuck with the small horses, however, because they had much more solid records from which to accurately date the samples.

The researchers used oxygen isotopes left by freshwater in the fossils to track mean annual temperature from when the animals had been alive. In particular, they sampled the isotopes from teeth of a large, water-dwelling mammal Coryphodon. With these isotope readings, "you get a little, tiny window as to what the temperature was at that time," Smith says.

This close reading has excited Smith and others who have been tracking animal size over the ages. "Although we knew that temperature might set a maximum for body size," Smith says, the new findings actually present a mechanism?and do so in a very detailed manner, showing "how animals responded to a particular temperature at a particular place at a particular time."

Victorinox Swiss Army Slim Flight

Portable storage can take many forms, but here's a flash drive that's a dead ringer for something you might already carry?the Swiss Army knife on your key ring. The Victorinox Swiss Army Slim Flight (4GB) ($40 street) is a small, lightweight USB flash drive with an attractive design and a potent software package.?Although it may not be the cheapest drive you'll find, it's easily one of the finest looking.

Design
The Slim Flight (4GB) lives up to its Swiss Army name, with a handsome pocket knife?style swiveling cover, complete with an integrated clip to secure and easily open the drive. No larger than a traditional Swiss Army keychain pocket knife, the cover of the slim USB drive is metal, with a textured surface and the Swiss Army logo. Our review unit came in silver, but other colors?orange, pink, green, and blue?are available. The cover has a handy locking mechanism to keep the drive closed while it rattles around in your pocket or luggage, and the drive can actually be removed from the cover and swapped out for one with?more memory without your?having to purchase the entire product over again.

The "Flight" moniker comes from the fact that there is no knife component to this Swiss Army flash drive. Other models include a folding blade, but anyone who regularly deals with the TSA knows that you don't want your data to be confiscated at the airport.

The drive is also very slim, measuring 0.3 by 0.6 by 2.3 inches (HWD)?the same size as a keychain Swiss Army knife?and weighs only 0.4 ounce. No worries about blocking other ports when using the drive?this USB device is about as small as it gets.

Despite the small size, you'll be getting anywhere from 4GB to 64GB of storage capacity, with models ranging between $40 (for the 4GB model) to $225 (for the 64GB model). Our review model, the 4GB version, costs $10 per gigabyte, which is pricey, to be sure. The cost per?gigabyte lowers as the capacity?increases, with the 64GB model coming out to roughly $3.51 per gigabyte.

Features and Performance
The Slim Flight (4GB) comes with some software preinstalled, courtesy of Victorinox. The software includes encryption tools, zero-footprint anonymous browsing, password management, and automatic file backup. These sorts of tools are invaluable when travelling for business, where you may be separated from your laptop or don't have consistent access to any one PC. Unfortunately, these tools are Windows only.

Setting up the encryption is simple, but it does involve a few minutes and multiple steps, so be prepared to spend some time with the installation wizard. First you set up a password for the drive. Next, you have the option of creating an encrypted partition on the drive. When you set up the encryption, the wizard includes a slider that lets you choose how much of the drive you want to encrypt. You can choose anywhere from the full capacity of the drive to as little as 10MB.

The software also includes options for Internet browsing, letting you either sync your favorites and bookmarks between multiple computers or browse safely on any system. The safe browsing mode opens up its own copy of Internet Explorer in "no trace" mode which, as the name implies, leaves no traces of your browsing on the PC. The safe browsing utility also lets you delete the history, cookies, favorites, and temporary files of either the local Internet log files or the USB-based browser. Extending the online communication tools further, there's also a tool to back up and sync your Outlook files to and from the USB drive.

In performance tests, the Swiss Army Slim Flight scored 631 points in Futuremark PCMark 7's storage benchmark, slightly ahead of the Kingston DataTraveler Locker+ (8GB) ($14 street, 4 stars), which scored 623. Despite the slightly better performance, and identical read speeds (24.52 MBps), the Victorinox Swiss Army Slim Flight has a slower write speed. In our timed test transferring 4.93GB of data, the Slim Flight had a write speed of 5.82MBps, while the DataTraveler Locker+ pulled ahead with a speed of 9.65MBps.

All in all, the Victorinox Swiss Army Slim Flight is the sort of drive you want to buy if you aren't worried about losing your flash drive. It's attractive, but not too bulky to carry on your key ring. It's filled with goodies like bookmark syncing, password management and easy to use encryption. It's also a bit more expensive than generic drives, without being dramatically faster. It's a smart buy, but you'll pay for what you're getting.

(AP) ? Well-equipped and familiar with the terrain, about a dozen expert skiers were making their way through a foot-and-a half of fresh snow when an avalanche hit them in an out-of-bounds area near a popular Washington ski resort.

Three men were killed Sunday when they were swept about a quarter-mile down a canyon, and a fourth skier caught up in the slide was saved by a safety device, authorities said. The large group had split into three smaller groups before the avalanche, but all the backcountry skiers were buried to some extent. Those who were able to free themselves rushed to dig out the victims and unsuccessfully performed CPR on the three, believed to be in their 30s and 40s.

"Most of the people involved in this were well-known to the ski community up here, especially to the ski patrol," said Deputy Chris Bedker of the King County Sheriff's search-and-rescue unit. "It was their friends who they recovered."

The Stevens Pass fatalities were part of a deadly Sunday on Washington ski slopes. A male snowboarder was killed in a separate avalanche incident at the Alpental ski area east of Seattle, authorities said.

The men who died on Stevens Pass tumbled approximately 1,500 feet down a chute in the Tunnel Creek Canyon area, King County Sheriff's Sgt. Katie Larson said.

The fourth skier who was swept down the mountain about 80 miles northeast of Seattle was a woman who appeared to avoid a similar fate because of the avalanche safety device she was wearing, Larson said.

ESPN.com identified the survivor as professional skier Elyse Saugstad, who said she used an airbag after the avalanche hit. ESPN Freeskiing editor Megan Michelson was among the skiers and was uninjured, it said.

Michelson said the initial slide was about 30 feet wide and three feet deep, but quickly grew as it swept away Saugstad and the three victims.

Saugstad said she immediately deployed the airbag from her backpack, crediting it with saving her life.

"I was completely buried except for my head and hands" after coming to a rest, she said.

Two of the victims were found nearby, while the third was carried "several hundred feet" farther down the mountain, Saugstad said.

Michelson said the remaining skiers called for help and skied the length of the avalanche track looking for victims, Michelson said.

"The debris pile at the bottom was massive," Michelson said.

Initial reports of the avalanche reached the sheriff's office just after noon, and for some time it wasn't clear whether the other skiers had also been swept up in the slide.

The Northwest Weather and Avalanche Center on Sunday issued a warning for high avalanche danger for areas above 5,000 feet, saying warmer weather could loosen surface snow and trigger a slide on steeper slopes. The elevation of the avalanche wasn't immediately clear.

At mid-afternoon, the temperature at the base of the Stevens Pass ski resort was 24 degrees, with light winds and good visibility. The temperature at the top of the mountain was 22 degrees, according to the resort's website.

John Gifford, the ski area's general manager, said Sunday that the resort had received 19 inches of snow in the past 24 hours.

He described the area as a popular backcountry skiing zone that can be easily accessed from the resort.

He said the slopes there are steeper than at the resort and lack the resort's avalanche control

"You need to be a highly skilled skier to do that," he said.

Stevens Pass is one of the most popular outdoor recreation areas in the state, with visitors flocking to the scenic site to go cross-country, back-country and downhill skiing, as well as snowshoeing and backpacking.

Across the West, there had been 13 avalanche deaths this season as of Thursday, according to the Colorado Avalanche Information Center, which tracks avalanche deaths in the U.S.

Experts have said the risk of additional slides in the region could remain high all season. They attribute the dangers in part to a weak base layer of snow caused by a dry winter.

Avalanche deaths are more common in the backcountry than at ski resorts. Out of about 900 avalanche deaths nationwide since the winter of 1950-51, 32 were within terrain that was open for riding at ski resorts, according to the Utah Avalanche Center.

ICE Long Beach shootout: As immigration cauldron boils, ICE agents buckle

The Long Beach, Calif., shooting that left one Immigration and Customs Enforcement agent dead and another wounded comes as the Obama administration has moved to improve morale among embattled ICE agents.

The internecine shootout that ended with one Immigration and Customs Enforcement agent dead and another critically wounded in Long Beach, Calif., on Thursday comes on the heels of an Obama administration effort to relieve dysfunction and morale problems within a frontline agency tasked with enforcing the nation's border laws.

The shootings came during an apparent counseling session between ICE supervisor Kevin Kozak and a lower-ranking supervisor, Agent Esequiel ?Zeke? Garcia, where a third agent was in the room as a witness. During the hearing, Mr. Garcia allegedly drew his service weapon and shot Mr. Kozak six times. The third agent drew his weapon and killed Garcia.

ICE Director John Morton flew to Long Beach Friday to meet with the wounded ICE supervisor and the agent who killed Garcia.

"Both of these men came to work yesterday never imagining if they would literally be fighting for their lives, but that is exactly what in fact happened, and they were tested in a very dangerous way and showed incredible fortitude," Mr. Morton said.

Morton's response to the deadly, puzzling drama is the latest attempt to confront problems rooted in the agency's creation in 2003, when it was formed as a merger between U.S. Customs and Border Enforcement and the Immigration and Naturalization Service.

As early as 2005, the Office of the Inspector General began noting troubling operational dysfunction within the nation's immigration enforcement ranks.

?Where collegial interactions should characterize relations between employees of the two organizations, we have been told of competition and, sometimes, interference. These organizational conditions have led to the articulation of mismatched priorities, competition and, at times, operational inflexibility," the OIG wrote.

More troubling, the OIG found at the time that agents reported seeing little action from the top to deal with the problems. ?We encountered concerns that institutional rivalries, duplication of functions and insularity of view were tending in a negative direction," according to the report.

Experts say that tensions within ICE remain high on a number of fronts. According to published reports, the Long Beach office, under Mr. Kozak, had become a hotbed of discontent, some of it linked to the INS-Customs rivalry. Kozak came from the Customs bureaucracy while Garcia began his career under the INS.

?While you might believe the mainstream media narrative that this was just a workplace rage incident, it?s actually?far deeper than that,? conservative talk show host and workplace attorney Debbie Schlussel writes on her blog. ?It?s a direct result of how bad things have gotten under the Obama administration and John Morton.?

The shootings came after a year when the agency scored some of its biggest immigration busts on record, with over 2,000 immigration scofflaws, including some violent ex-convicts, rounded up in a series of national sweeps last summer.

The agency has also been at the forefront of a White House administration effort to force ICE employees to use prosecutorial discretion to stop prosecution of undocumented immigrants who have deep ties to the US, an effort that has been widely criticized, even vilified, by agents in the field.

Meanwhile, there are other signs of an agency in turmoil. Aside from Thursday's shooting, there were three other incidents in 2011 where ICE agents were caught up in illicit activities.

Last fall, a supervisor in the agency's South Florida office was arrested on child pornography charges. Also last fall, an ICE agent was arrested for drug smuggling following a car chase. In May, an ICE agent in New York was arrested and charged with stealing government property and selling it on eBay.

Last month, Morton addressed a Federal Employee Viewpoint Survey where ICE was ranked 222nd ?on a list of 240 federal agencies, proposing a new initiative to tackle ?morale? problems.

?Although ICE, as a relatively young agency, has faced challenges that other more mature, long-established agencies have not faced, these challenges do not diminish our concern about the rankings,? Morton wrote. ?We want to improve the satisfaction of our employees who work every day to carry out our critical mission.?

Morton promised a series of ?town halls? to gauge the situation and propose initiatives to improve morale.

The Forest, the Trees, and the Next Big Thing

forestThey say hindsight is 20/20. By now, everyone knows about the fastest-growing site on the web. Yet, for a period of time in 2011, despite all the signals pointing toward the phenomena, most in Silicon Valley weren?t able to sniff out the trend even though, looking back, the clues were right under our noses. I wanted to write this post to offer a theory as to why the Valley, at large, missed this trend. Additionally, I want to underscore that this post is less about Pinterest, and more about how even the most focused, attentive audiences can miss the forest for the trees.
