Egypt news agency confirms envoys met Shater

CAIRO (Reuters) - Western and Arab envoys met senior Muslim Brotherhood leader Khairat El-Shater on Monday at the jail where he is being held, Egypt's state news agency reported on Monday, contradicting an earlier denial of a visit by the Interior Ministry.

The MENA agency cited an "informed source" as saying the envoys seeking to mediate an end to Egypt's crisis had received permission from the prosecutor general to visit Shater.

"(The delegation) met Shater from 12 (midnight) until 1 a.m.," it said.

Discarded NYC theater prop sparks bomb scare

NEW YORK (AP) ? A New York City playwright who directed a show called the "American Suicide Bomber Association" unwitting sparked a bomb scare when he threw a prop from the production into the trash at his home.

Playwright Ethan Fishbane tells The New York Post (http://bit.ly/16Pymas ) he wasn't thinking when he discarded the fake bomb while cleaning out his Manhattan apartment Tuesday.

A building superintendent saw the prop the next morning and called police.

That brought out the bomb squad.

It didn't take long for investigators to figure out what had happened.

Fishbane says he was stunned when officers knocked on his door, but he praised the department for its quick response, saying it was "wholly appropriate."

The 23-year-old wrote the play while attending New York University's Tisch School of The Arts.

Pension panel, Chattanooga Mayor Andy Berke clash

The president of Chattanooga?s Fire and Police Pension Board on Thursday said Mayor Andy Berke and his administration are manufacturing a crisis about the viability of the fund.

Terry Knowles said during a pension board meeting that the dismal pension outlook portrayed by the Berke administration is ?nothing more than an accounting scenario.?

?There is not a crisis with our plan today,? Knowles told pension fund board members. ?This fund is sustainable.?

In his proposed 2014 budget, Berke proposed a $14.4 million allocation to the pension fund.

But Frank Hamilton, pension fund administrator, told board members that the $14.4 million figure is ?puzzling.?

Pension officials said their projection for the city?s contributions was $13.3 million ? a $1.1 million difference.

Berke fired back Thursday afternoon.

?It?s sad that the Pension Board would rather play politics by asking me to reduce a contribution to an underfunded pension rather than commit to finding a solution,? Berke said in a statement. ?I will not let down our firefighters and police officers because of pension board politics.?

Hamilton said he sent city Chief Financial Officer Daisy Madison information from an actuarial study, by The Segal Co., that shows the annual required contribution is a dollar amount, not a contribution based on percentage of payroll.

?If the city contributes based on a percentage of payroll, but payroll increases are not at the level expected, the city may end up not paying the full amount of the annual required contribution,? the memo states.

In Berke?s proposed budget, the city would give police officers and firefighters a 1.5 percent pay raise rather than 3.25 percent used to calculate the contribution. Pension officials also said the addition of 40 new police officers will increase the number of people paying into the fund.

?If that?s where the $14.4 [million] comes from, then it?s an inflated number,? said Ray Ryan, pension board member.

A new contribution requirement has not been calculated by pension officials, but they estimate the required contribution will actually be lower.

?Give us extra money. ? We?re fine with that, but don?t go out there and say it?s required because it?s going up this much. It?s not required,? Knowles said.

Madison said the city has used the same system to calculate city contributions to the fund for at least 20 years.

?Every year, we receive a dollar amount to contribute to the fund based on a projected payroll. We apply the same rate to our budgeted payroll to determine our actual contribution,? she said in a statement. ?Over the past five fiscal years, we have contributed $1,968,078 over the annual recommended contribution. Despite our over contribution to the fund, it is still underfunded by $150 million.?

The study conducted by Segal shows that to fully fund the fire and police pension fund within 25 years, the city?s annual contributions will need to triple by 2038.

Berke is in the process of creating a task force to study the pension and hire another company, Public Financial Management Inc., to find ways to limit costs to the city.

Knowles said board members are open to working with the administration, but believes a task force is unnecessary.

?The board understands the administration has concerns about the rising pension costs, and we are more than willing to work with the administration today in an effort to find a shared solution that addresses the city?s concerns. ? Unfortunately the mayor made a decision to go a different direction and form a pension review task force that will study our fund and make recommendations on modifications to the pension plan,? Knowles said.

Members of the task force have not been named. However, police and fire chiefs, union representatives, retirees from departments and community leaders are expected to participate. The pension board voted Thursday to send Knowles as its representative.

Facebook reveals Bug Bounty numbers, has awarded over $1 million in reward

Facebook wants you to know it's taking security seriously -- enough for Zuckerberg and Co. to pay out over $1 million in reward within two years for its Bug Bounty program. According to a recent blog post, it's awarded a total of 329 digital bounty hunters at least $500 for discovering and reporting security issues to the social network. The participants came from all walks of life across the globe (the youngest being a 13-year-old), and the most resourceful ones have already made more than a hundred grand each. Facebook isn't alone in exchanging big money for bug reports -- Microsoft, for one, is offering up to $100,000 to anyone who discovers security exploits on the preview version of Windows 8.1. Despite Facebook's success, however, over 6 million accounts were still exposed in June... proving that when it comes to security, tech companies can never sit on their hands.

Feds, states want Apple to revamp e-book practices

(AP) ? The Justice Department and 33 state attorneys general on Friday said they want to prevent Apple from entering into contracts with sellers of e-books, movies, music and other digital content that are likely to raise prices.

The demand comes out of an antitrust suit against Apple Inc. and five e-book publishers. A federal judge ruled last month that Apple had colluded with the publishers to raise e-book prices.

The Cupertino, Calif., company has denied wrongdoing and has said it will appeal the decision. On Friday, it called the remedy proposal "a draconian and punitive intrusion into Apple's business." The inclusion of digital media other than books in the proposal doesn't bear any relation to the findings in the case, Apple said.

The book publishers previously settled the price-fixing charges. They are Hachette, HarperCollins, Simon & Schuster, Holtzbrinck Publishers, doing business as Macmillan, and The Penguin Publishing Co. Ltd., doing business as Penguin Group. The settlements were designed to encourage price competition and discounting, but that hasn't happened.

The government alleged that the publishers colluded with Apple to move the e-book industry away from the wholesale model employed by Amazon.com Inc., which had unnerved publishers by selling e-book versions of popular hardcover titles for as little as $9.99 before the April 2010 release of Apple's iPad. Under its contracts with publishers, Amazon was free to sell books at any price it wanted.

Apple instead adopted the "agency" model, under which publishers set the retail price and the store takes a cut. Under that model, the store can't discount a book. That pressured Amazon into accepting the agency model, the government alleged.

The government wants Apple to agree to sign new contracts with the publishers that aren't likely to raise prices. In its response Friday, Apple said the government's proposed remedy is unnecessary, since the publishers are already signing new wholesale contracts.

In her ruling in July, the judge said the conspiracy harmed consumers in numerous ways. Some had to pay more for e-books, she said. Others bought cheaper e-books rather than the ones they preferred to purchase and others deferred purchases altogether rather than pay higher prices.

The settlements with the publishers removed the shackles that prevented Amazon from discounting, but the $9.99 price for e-books that publishers dreaded has become increasingly rare.

The Justice Department and the attorneys general also want Apple to allow rival e-book sellers like Amazon and Barnes & Noble Inc. to provide links inside their iPhone and iPad apps to their own book stores.

Apple allows Amazon and Barnes & Noble's apps to load books that have already been purchased, but doesn't allow the apps to sell books or link to online bookstores.

Ariel Castro victim Michelle Knight: 'Your hell is just beginning'

For the first time, Michelle Knight confronted the man who held her captive for 11 years, telling Ariel Castro she spent more than a decade in hell, and now "your hell is just beginning." Castro was sentenced to life in prison without parole, plus 1,000 years. NBC's Kate Snow reports.

By Matthew DeLuca, Staff Writer, NBC News

Cleveland kidnapper Ariel Castro was sentenced to life in prison without parole on two counts of aggravated murder plus 1,000 years on Thursday after a sentencing hearing filled with sordid details of his crimes ? and tremendous perseverance and hope as victim Michelle Knight faced down her captor in court.

?I cried every night, I was so alone,? Knight said. ?Years turned into an eternity.?

?I spent 11 years in hell, where your hell is just beginning,? she said to Castro, with her back turned to him at the defense table. ?You deserve to spend life in prison.?

?After 11 years, I am finally being heard, and it is liberating,? Knight said.

Handcuffed and in an orange prison jumpsuit, a bearded Castro appeared to smile as he entered the courtroom where he came face to face with the terror he inflicted on the three women. Castro, who imprisoned them for a decade?in his Cleveland home, seemed to laugh as the court took a brief recess around noon.

After Knight spoke and others gave statements for her fellow captives Amanda Berry and Gina DeJesus, Castro delivered a long, rambling statement.

?These people are trying to paint me as a monster. I?m not a monster, I?m sick,? Castro said. He described himself as addicted to masturbation and pornography, and claimed that he was ?a victim of sex acts? when he was a child.

Of his young daughter who was born in captivity, Castro said: ?She?ll probably say, ?My daddy is the best daddy in the world.? Because that?s how I tried to raise her in those six years. So she wouldn?t be traumatized or anything like that.?

Cleveland kidnapping victim Michelle Knight delivers an emotional statement to the courtroom, telling Ariel Castro, "I spent eleven years in hell. Now your hell is just beginning."

?I am not a violent person. I simply kept them there without them being able to leave,? Castro said.

??To this day I?m trying to answer my own questions. I don?t know why a man that had everything going on for himself ? I had a job, I had a house, I had vehicles, I had my musical talent,? the confessed kidnapper and rapist said.

?We had a lot of harmony going on in that home,? he said.

The victims other than Knight were represented by relatives at the hearing.

DeJesus was represented by her cousin Sylvia Colon, who said the young woman lives ?not as a victim, but as a survivor.?

Berry?s sister Beth Serrano said the family did not want to continue to talk about their ordeal, and even if she did, ?it is impossible to put in words.? Berry is concerned that her daughter will hear versions of her story before she is ready.

?Amanda did not control anything for a long time,? Serrano said. ?Please let her have control over this so she can protect her daughter.?

Prosecutors revealed photos from inside Castro?s Seymour Avenue home, including some that showed the bedroom, stocked with stuffed animals and other brightly colored children?s toys, where Berry and her daughter spent much of their time, FBI Special Agent Andrew Burke said. Others showed chains hanging from walls where two of the women endured their nightmarish captivity.

Witnesses including police officers and medical experts revealed the terrifying details ? including that more than 90 pounds of chains, measuring nearly 100 feet, were recovered from the home.

The chains were not displayed in court.

Cleveland Police Department Patrolwoman Barb Johnson, one of the initial officers to arrive at Castro?s house after Berry kicked through the front door on May 6, was the first witness on Thursday. The officer described entering the darkened house with a flashlight attached to her firearm.

She and another responding officer heard the ?pitter-patter? of steps as they entered the house and went to the second level. Then, a woman who turned out to be Knight emerged from the darkness.

Knight ?launched herself? into the other officer?s arms, Johnson said.

Detective Andy Harasimchuk of the Cleveland Police Department?s sex crimes unit described how the victims were physically restrained for periods by Castro, and were chained and locked in rooms of the house.

The doctor who saw the three women after they were first removed from the house, Dr. Gerald Maloney, said the women were ?very much emotionally fragile? when they first arrived at the hospital.

Tony Dejak / AP

Sheriff's deputies set in place a model of the house on Seymour Ave. where Ariel Castro held three women Thursday, Aug. 1, 2013, in Cleveland. Three months after an Ohio woman kicked out part of a door to end nearly a decade of captivity, Castro, a onetime school bus driver faces sentencing for kidnapping three women and subjecting them to years of sexual and physical abuse.

?All three of them looked fairly gaunt, all three of them related that they had been allowed minimal time outside the house at all,? Maloney said. ?They related information regarding sexual assaults to us and also to the sexual assault nurse examiner.?

The interior of the house featured modifications that enabled Castro to keep the women in and inquiring eyes out, FBI Special Agent Andrew Burke said, including modified doors, extra partitions and the conversion of the dining room into a bedroom. A porch swing was positioned at the base of the stairs going to the house?s upper floors as an obstacle, he said.

?There were a number of modifications to the interior of the home to fortify certain areas,? Burke said. ?There were divisions between spaces in the house that were again designed not only to make the house more secure for its occupants but also to hide, I think, the existence of additional rooms in the house.?

Other photos showed the cluttered basement with its white center pole where the women were restrained ?in the early stages of captivity,? Burke said, as well as a laundry machine full of money. Investigators also found a note in which Castro wrote ?I am a sexual predator,? according to the agent.

Castro?s victims said he played a version of ?Russian roulette? with them, giving the women a revolver he kept in the house, said Cuyahoga County Sheriff?s Deputy Dave Jacobs, who interviewed the man in the days after the women were freed. Castro told him he didn?t specifically remember the incident, but said if the women said it happened, it probably had, according to Jacobs.

In opening remarks, Castro?s defense attorneys objected to the presentation of any photographs or other exhibits to demonstrate the extent of their client?s offenses. Attorney Craig Weintraub said that the highly unusual case has ?facts that are incomprehensible? and that his client suffered from ?significant, undiagnosed mental illness? that did not rise to the legal definition of insanity.

A sentencing memorandum filed by Cuyahoga County Prosecutor Timothy J. McGinty on Wednesday included accounts of how Castro abducted Berry, Knight, and DeJesus between August 2002 and April 2004.

Prosecutors ask FBI special agent Andrew Burke to describe the pictures from inside Ariel Castro's Cleveland home, particularly the chains used on the three women he kept captive for a decade.

Knight ?was spotted by the Defendant in need of assistance in getting to an appointment regarding her son,? according to the sentencing memorandum. ?The Defendant lured her into his vehicle with promises of a ride. The Defendant then took Ms. Knight to his home at 2207 Seymour Avenue and enticed her to go inside with promises of a puppy for her son.?

The women?s daily life was recorded in diary entries, which were reflected in the more than 900-count indictment against Castro.

?The entries speak of forced sexual conduct, of being locked in a dark room, of anticipating the next session of abuse, of the dreams of someday escaping and being reunited with family, of being chained to a wall, of being held like a prisoner of war, of missing the lived they once enjoyed, of emotional abuse, of his threats to kill, of being treated like an animal, of continuous abuse, and of desiring freedom,? according to the memorandum.

At one point, from Aug. 23, 2005 to the end of October 2005, Castro "forced the three victims into the garage behind his house," the memorandum states. "For three days, they were kept physically restrained in a vehicle in the garage, while the Defendant had a visitor at his house."

If any of the three women tried to escape, the memo said, Castro would assault her and force the other two to watch. He sexually abused the women on a regular basis, according to the memo, and when one of these assaults resulted in Knight becoming pregnant, Castro starved and beat her in a successful attempt to terminate the pregnancy. That formed the basis of the aggravated murder charge to which Castro pleaded guilty.

Berry gave birth to her child in captivity without any medical care.

The women suffered from post-traumatic stress disorder from their prolonged torment, Dr. Frank Ochberg, a clinical psychologist who is an expert on post-traumatic stress disorder, said on Thursday.

All three endured ?repeated episodes that were terrifying, the kind of trauma that we meant when we define the post-traumatic stress disorder,? Ochberg said. ?The kind of trauma that you don?t escape for years and sometimes for a lifetime.?

?You are being infantilized, then little by little you?re given what it takes to survive,? Ochberg said. ?You deny that this is the person who did all of this to me, and you start to feel as you did as a little baby, with your mother.?

Michelle Knight, one of the Cleveland kidnapping victims, smiles widely as Judge Russo sentences her captor Ariel Castro to life in prison without parole.

The women survived in part because of extraordinary, and simple, acts of human kindness between them, the doctor said, even if they will never be entirely free of the damage done them by Castro.

Knight, he said, is ?an extraordinary human being. She served as doctor, nurse, pediatrician midwife ?. She?s a very courageous and heroic individual.?

"Little by little, you are allowed 'the gifts of life,'" Ochberg wrote. "You are like an infant, totally dependent on your mother for survival. As you receive these gifts of life, without consciously realizing what is occurring, you feel some warmth ? even love ? toward that life giver."

Castro?s son Anthony Castro told the TODAY show on Monday that he did not think he would visit his father in prison.

?I think that if he really can?t control his impulses and he really doesn?t have any value for human life, the way this case has shown, then behind bars is where he belongs for the rest of his life,? the son said. ?I have nothing to say to him.?

Castro pleaded guilty to 937 counts including rape, kidnapping, and aggravated murder. Prosecutors dropped 40 more counts that were considered redundant.?

"A person can only die in prison once," the judge noted on Thursday after imposing Castro's sentence.

S&P 500 crosses 1,700 points for the first time

NEW YORK (AP) ? The stock market got jolted out of the summer doldrums Thursday by better news on the economy, sending indexes back to all-time highs.

The Standard & Poor's 500, the Dow Jones industrial average and the Russell 2000 index were all on track to set new records. The S&P broke through 1,700 points for the first time.

The gains were driven not by any one major event but by a steady flow of encouraging, if incremental, reports on the global economy.

Overnight, a positive read on China's manufacturing helped shore up Asian markets. Then, an hour before the U.S. market opened, the government reported that unemployment claims fell last week. After the market opened, a trade group announced that U.S. factories revved up production last month. And throughout the day, while company earnings reports brought both winners and losers, investors were able to find enough that they liked in companies including CBS and Yelp.

"It's just a lot of things adding up," said Russell Croft, portfolio manager of the Croft Value Fund in Baltimore. "It's hard to put your finger on why exactly, but basically it's a bunch of pretty good data points coming together to make a very good day."

Overall, analysts said, the news was good but not overwhelmingly so ? enough to give hope that the economy is improving, but not enough to prompt the Federal Reserve to withdraw its economic stimulus programs.

Earnings results covered a wide range. Boston Beer, which makes Samuel Adams, and home shopping network operator HSN rose after beating analysts' estimates for earnings and revenue. Kellogg, the health insurer Cigna, and cosmetics maker Avon were down after beating earnings predictions but missing on revenue.

It's becoming a familiar template this year. Stock indexes have been setting record highs even while the underlying economy is more often described as decent, but no going gangbusters.

Take company earnings, the most important thing for stock investors. Earnings at S&P 500 companies are up 4.8 percent this quarter, and revenue is down 0.5 percent, according to S&P Capital IQ. In previous eras, that hardly would have been considered encouraging. In the second quarter of 2007, before the financial crisis imploded, earnings rose 9 percent and revenue rose 6 percent. Compared with the second quarters of 2008 and 2009, when earnings plunged, this year's results look relatively good.

Other economic indicators have been following a similar fashion. While layoffs are steadily declining, companies aren't hiring as quickly as they did before the crisis. The economy is growing, but not fast enough to drive significant job growth. The Commerce Department reported this week that the U.S. grew at a tepid annual rate of 1.7 percent in the second quarter.

"They're not great numbers, but they're positive and they're continuing to grow," said Tim Courtney, chief investment officer of Exencial Wealth Advisors in Oklahoma City. "That's about all the market needs to hear."

The S&P 500 was up 21 points, or 1.2 percent, to 1,707 in the final hour of trading. The Dow rose 128 points, or 0.8 percent, to 15,627. The Russell 2000 rose 14 points, or 1.3 percent, to 1,059.

The Nasdaq composite index rose 46 points, or 1.3 percent, to 3,672, in line with the daily gains of the other indexes but not near its record. The Nasdaq, which is heavily weighted with technology stocks, briefly veered above 5,000 in 2000, just before the bursting of the Internet bubble.

Investors said Thursday that the S&P's crossing of the 1,700-point line might give consumers a psychological boost, but they were hardly crowing about a new era in stocks. Turns out it's quite common for stock indexes to hit records. Since 1950, the S&P 500 has hit a new high about 7 percent of the time, or an average of about every 15 days, Courtney said.

The S&P 500 did make the jump to 1,700 from 1,600 in less than three months. The index first traded above 1,600 on May 3. The previous 100-point gain took much longer to achieve: The index first closed above 1,500 in March 2000.

The market's sharp advance Thursday was a stark contrast with the previous two days, when the S&P 500 moved less than a point each day. On Tuesday, investors didn't want to make big moves ahead of the Federal Reserve's policy announcement the next day. On Wednesday, the Fed didn't make much news after all. The central bank said, unsurprisingly, that the U.S. economy was recovering but still needed help. The Fed didn't give any indication of when it might cut back on its bond-buying program, which has been supporting financial markets and keeping borrowing costs ultra-low.

Among the economic and corporate news that investors digested Thursday:

? China's purchasing managers' index ? a gauge of business sentiment ? rose to 50.3 in July from 50.1 in June. Analysts had expected a modest decline below 50.

? The Labor Department said that the number of Americans applying for unemployment benefits fell 19,000 to 326,000. That was the fewest since January 2008.

? The Institute for Supply Management, a trade group of purchasing managers, said Thursday that its index of factory output jumped to 55.4 in July, up from 50.9 in June. A reading above 50 indicates growth.

? Auto companies reported healthy sales gains for July. Ford, Chrysler and Nissan each reported sales growth of 11 percent compared with the same month a year ago.

An index of transportation stocks also rose sharply. Many investors see that sector as a leading indicator for the economy since freight and shipping companies tend to get busier as the economy improves.

The Dow Jones Transportation Average jumped 217 points, or 3.4 percent, to 6,679, led by a surge in Con-Way, a Michigan-based freight company that reported earnings Thursday that were far higher than investors expected. Con-Way rose $4.36, or 11 percent, to $45.81.

The price of crude oil rose $2.86, or 2.7 percent, to $107.89 a barrel. Gold slipped $1.80 to $1,311.20 an ounce. The dollar rose against the euro and the Japanese yen.

The yield on the 10-year Treasury note rose sharply, to 2.72 percent from 2.58 percent late Wednesday. That means investors were selling U.S. government debt securities, which are seen as ultra-safe, in anticipation that the economy would pick up and as they to moved money into higher-risk assets like stocks.

Among stocks making big moves:

?Sprouts Farmers Markets more than doubled on the company's first day of trading, jumping $20.37 to $38.36 ? another sign that investors are increasingly comfortable with higher-risk investments.

?Yelp soared 26 percent, up $10.70 to $52.50. The review website continued to lose money, but it sold more ads and drew more visitors.

?Dell rose 29 cents, or 2 percent, to $12.95. Its shareholders are scheduled to vote Friday on an offer by CEO and founder Michael Dell to buy the company.

?Exxon Mobil fell $1.27, or 1 percent, to $92.48, after reporting lower earnings as oil and gas production slipped. Profit margins on refining oil also fell.

Marriott posts $179M profit on higher occupancy

Hotel giant Marriott International Inc. said Wednesday that second-quarter earnings rose as business and leisure travelers continued to book hotel rooms and paid slightly more for them.

Marriott, based in Bethesda, Md., earned $179 million, or 57 cents a share, in the three-month period ended June 30. That's up from $143 million, or 42 cents per share, a year ago.

A change in the company's fiscal year meant seven extra days in the quarter this year compared to last year.

Revenue rose 18 percent to $3.26 billion.

Analysts expected earnings of 57 cents per share and revenue of $3.20 billion, according to FactSet.

The company's revenue per available room ? or REVPAR ? was $129.59, up 4.4 percent from the prior year. That key figure increased thanks to slightly higher occupancies and a 3 percent gain in the rates charged to guests.

"Both business and leisure transient demand were strong in the quarter, more than offsetting weak short-term group business," Arne M. Sorenson, Marriott president and CEO, said in a statement.

"As occupancy rates reach 2007 peak levels for many brands, room rates are moving higher, improving hotel profitability and incentive fees," Sorenson said.

Marriott now expects its revenue per available room to increase 4 to 6 percent worldwide for the full year, down from its outlook last quarter for growth of 4 to 7 percent.

The company expects its annual earnings per share to be $1.92 to $2.03, slightly lower than Wall Street analysts' estimate of $2.04. Marriott's stock fell about 2.6 percent in after-hours trading. It gained 18 cents to $41.57 in the regular session.

Marriott doesn't own most of the hotels in its system but makes money off either managing or franchising its 18 brands. Those include Ritz-Carlton, Fairfield Inn & Suites, Courtyard, SpringHill Suites and Renaissance.

Marriott added 43 new properties, with a total of 6,203 rooms, to its worldwide lodging portfolio in the quarter. Eighteen properties, with 3,225 rooms, exited the system. As of June 30, the company was responsible for 3,847 properties and timeshare resorts globally with more than 666,000 rooms.

The company's worldwide pipeline of hotels under construction, awaiting conversion or approved for development increased to nearly 850 properties with more 140,000 rooms.

What to Watch for in Friday?s Jobs Report

This has been quite a week for anyone following the economy: a Fed meeting, a GDP report, plus data on housing, consumer confidence and most recently manufacturing. Still, the biggest report of all is yet to come: The monthly jobs report will be released at 8:30 a.m. on Friday. Economists estimate the U.S. added 183,000 jobs in July and expect the unemployment rate to tick down to 7.5%. Here are five things to look for in the report.

Does the trend hold steady? The month-to-month numbers get the attention, but what matters ? for both the economy and, crucially, for the Federal Reserve ? is the trend. That means watching not just the July figure but also the revisions to data from May and June. The pace of hiring has held remarkably steady over the past year at right about 200,000 jobs per month, even as economic growth has been uneven and disappointing. That resilience will have to continue if the Fed is to begin winding down its $85-billion-a-month bond-buying program at its September meeting, as many economists expect. Even a continuation of the recent trend would be far too little to bring down unemployment quickly or drive up wages; that would require a sustained acceleration in hiring, not just a one or two-month uptick.

Has the consumer slowdown hit the job market? The household sector has helped prop up both the economy and the job market over the past year, but there have been recent signs that strength may be fading. Consumer spending cooled in the second quarter, and restaurant spending has fallen for two months in a row. So far, the slowdown hasn?t affected hiring: The leisure and hospitality sector, which includes restaurants, added 75,000 jobs in June, and retailers tacked on another 37,000. Together, the two sectors account for more than a third of all private-sector payroll growth over the past year, so any pullback in hiring could spell trouble for the job market.

What about government? The public sector has been a drag on job growth since early in the recovery, shedding more than 900,000 jobs over the past three years. There are signs that may be changing, however. On the federal side, the sequester has led to furloughs but fewer outright job cuts than many economists initially expected. Meanwhile, local governments are hiring again, adding workers in seven of the past eight months. The public sector isn?t likely to provide a big boost to payrolls anytime soon, but it may at least ease off the brake.

What happens to wages? Average hourly wages rose 10 cents in June, the biggest one-month jump in the recovery. Over the past year, non-inflation-adjusted wages are up 51 cents ? hardly a big leap, but a significantly stronger pace than earlier in the recovery. Continued wage growth would be good for both workers and the broader economy, and might also help ease the Fed?s concerns about low levels of inflation. But many economists doubt wage gains can continue while unemployment remains high. Indeed, other indicators suggest that many workers are being forced to settle for jobs that are low-paying, part-time or temporary. More than 8 million Americans are working part-time because they can?t find full-time jobs ? a figure that?s been more or less flat for the past year ? and many of the jobs that are being created are in low-wage sectors.

Can labor force growth continue? One of the most worrying trends in the recovery has been the continued erosion of the labor force. The share of the population that?s working or looking for work ? a measure known as the participation rate ? plunged during the recession, then kept on falling, hitting a more than three-decade low earlier this year. But the labor force has grown by more than 800,000 over the past three months, and the participation rate has ticked up for two months in a row. Economists have so far been hesitant to declare a turnaround, but the longer the trend continues, the more it will start to look like workers are returning to the job market, which would be a key sign that the scars of the recession are at last beginning to heal.

CONNECTICUT OPEN GOLF: Curl leads Caron, Shelton's St. Pierre 4 shots back

GOSHEN?? Jeff Curl hasn?t been in this position in five years - sitting on a lead heading into the final round of a golf tournament.

After birdieing his first three holes to take the outright lead at the Connecticut Open, Curl never looked back. He fired his second straight 3-under-par 67 at Torrington Country Club to move to 10-under for the tournament and take a three-shot lead.

?My ball-striking, I feel like I have been doing this all summer. I just haven?t been in a tournament where I can showcase it,? said Curl, an Ellington native.

Curl leads defending champion Jason Caron by three shots and four other golfers (Jim St. Pierre, Tommy McDonagh, Eric Steger and Bill Downes) by four. Curl and Caron will play in the final group at 11:40 a.m.

St. Pierre, a Shelton resident and assistant pro at Redding CC, is having his best effort in the Open since winning it in 2002 at New Haven CC. He made seven birdies en route to a 4-under 68 and a 6-under 138 total. He did it all despite tweaking a recurring back injury on the third hole.

?I played basically 15-16 holes today, so I don?t think it can get any worse,? St. Pierre said.

Mike Ballo Jr. is seventh at 4-under 140 and four more golfers are tied for seventh, but seven shots behind Curl.

Just 15 players are under par for the tournament, including two-time champion Frank Bensel and 2003 winner and Milford resident Steve Sokol, both of whom are at 1-under 143. The cut came at 4-over 148. Among those missing the cut are Cody Paladino, the reigning Connecticut State Amateur champion (149), New Haven CC assistant pro Bill Street (149), former Yale University golfer Jeff Hatten (150), Jerry Courville Jr. (151) and Ivan Lendl (157).

Cory Muller, a Torrington native who now plays out of CC of Darien, also missed the cut by 1. He played both days with Lendl and former PGA Tour winner Ken Green. Continued...

?I knew I had to shoot even par or better today and just didn?t make any birdies,? Muller said. ?The greens were considerably slower today. I?ve been playing the greens for 20 years. Even if your brain sees and knows something, it?s tough to get your body to change what it feels.?

Curl, 34, shot a final-round 65 to come from behind to win the Open in 2007 at Lake of Isles. His last win came in October of 2008 on the EGolf Tarheel Tour.

?If I?ve learned anything in golf, I can?t control what anybody does (today),? Curl said. ?I?m positioned and like the way I?m playing. ... As long as I go do what I need to do, I should be fine.?

Caron had the lead outright early Tuesday when he birdied five of his first 11 holes to get to 7-under for the tournament. The defending champion fired a 66, which included a 50-footer for par on the third hole.

?It was an awesome announcement on the first hole (being recognized as defending champion),? Caron said. ?As soon as they announce it, I?m ready to play golf, I?m ready to get into my zone and just play.?

The 66 included nine 3s on Caron?s scorecard. ?I can?t remember the last time I had nine 3s.?

St. Pierre, 41, said the swing on the third hole ?almost forced him down to one knee? the pain was so bad. Yet he managed to post another under-par round at the club where he was an assistant pro in 2000.

?From that point on, it was just survival,? St. Pierre said.

McDonagh is a two-time Connecticut State Amateur champion (2006 at Torrington CC, and 2011) and Met Amateur winner (2006 and 2008), one of the few players ever to win both twice. He shot a 70 at 6-under 138 through two rounds at the Open.

?It was twice as hard as yesterday,? McDonagh said. ?And the higher you go up (in elevation), the harder (the wind) blows. ... I hit a lot of greens. I didn?t make it too hard on myself.? Continued...

Downes, the head pro at Hampden CC in Hampden, Mass., made five birdies and one bogey to post 68 in his first Open and get into contention for today?s final round.

?I haven?t been in the heat (competition for a title) for a long time,? Downes said. ?It?s right around where I?ve got to be, with a chance if I can get something going. ... I don?t hit it quite as long anymore, but that?s not really a factor out here. You have to place yourself around this golf course.?

Steger, a co-leader in the first round with Curl, shot 71 to be in the group at 6-under.

After Asiana crash, use GPS, not eyeballs

SAN FRANCISCO (AP) ? The Federal Aviation Administration is advising all foreign airlines to use a GPS system instead of visual approaches when landing at San Francisco International Airport in the wake of the deadly Asiana Airlines crash.

The San Francisco Chronicle reports (http://bit.ly/17anAKZ ) the FAA issued a recommendation Sunday that the airlines use the GPS system when landing on main runways instead of relying on just their eyes and cockpit instruments.

Pilots on Asiana Airlines Flight 214 had been cleared to make a visual approach when the plane crash-landed on a runway at the San Francisco airport July 6. Three girls died, and 180 people were injured.

The FAA says that since then, pilots for Asiana and other foreign carriers have had more aborted landings than usual while trying to make visual approaches. The agency didn't provide exact numbers.

Pfizer earnings beat forecasts as drugmaker plans split

(Reuters) - Pfizer Inc reported second-quarter earnings slightly ahead of forecasts on Tuesday as the United States' largest drugmaker lines up a business split that could lead to the spin-off of its generics division.

The company, which has been hit by falling sales of its now off-patent cholesterol fighter Lipitor, reaffirmed its financial outlook for the year.

For the second quarter, adjusted income fell 10 percent to $4.00 billion, or 56 cents a share, from $4.45 billion, or 59 cents a share, a year earlier. Revenue fell 7 percent to $12.97 billion.

Analysts, on average, were expecting second-quarter income of 55 cents a share, on revenue of $13.01 billion, according to Thomson Reuters I/B/E/S.

Pfizer, whose CEO Ian Read has been reviewing the group's structure after divesting its nutrition and animal health businesses, said on Monday it planned to separate its commercial operations into two units for branded products and a third for generics.

Read said Pfizer's new model would help revitalize its innovation-based core drugs business, while enhancing the value of consumer and off-patent established brands, and maximizing the use of capital.

Pfizer's generics business, which represents 17 percent of total sales, has far lower profit margins than its patent-protected drugs.

Many analysts have urged Pfizer to spin off its generics business so it can focus on its core branded pharmaceuticals, although such a move is unlikely before 2016.

Within the core drugs division, revenues from cancer medicines increased by 28 percent in the second quarter, helped by new products like Inlyta and Xalkori.

Read also said he expected business in emerging markets to accelerate in the second half of the year, led by China.

"From a total company view, we are tracking to our expectations for the full year and continue to capitalize on the investments we are making to better position Pfizer for long-term success," he added.

Pfizer reiterated that it expected full-year earnings of $2.10 to $2.20 per share.

LIPITOR AND PREVNAR HITS

The 7 percent fall in quarterly revenue reflected an operational decline of 4 percent and an unfavorable impact from foreign exchange of 3 percent.

Operationally, the biggest hit came from losses of exclusivity on Lipitor, while shifts in government purchasing patterns for bulk orders of Pfizer's Prevnar pneumococcal vaccine also took their toll.

The U.S. drugmaker's determination to reshape its business is part of a wider trend by pharmaceutical companies around the world to divest slower-growing and maturing operations.

Abbott Laboratories's decision to split off its innovative drugs into AbbVie , in particular, has fueled a wider rethink across the industry as to whether other companies or groups of investors may be better owners for certain assets.

In Europe, GlaxoSmithKline is also selling off certain non-core brands, and in April it took a similar tack to Pfizer by opting to bundle many of its established drugs into a new unit.

Pfizer last November sold its nutrition business to Nestle SA for $11.85 billion in cash and in February spun off its animal health business into a new company called Zoetis .

Driver in Spanish train crash faces questions from judge

Francisco Garzon is now under arrest, as the investigation centers on his role in the crash that killed or injured almost everyone on board. NBC's Keir Simmons reports.

By Tracy Rucinski, Reuters

SANTIAGO DE COMPOSTELA, Spain - The driver of a Spanish high-speed train that derailed and killed 79 people was released pending trial on charges of reckless homicide, a judge ruled on Sunday night.

Francisco Garzon, 52, had been under arrest since Thursday. He is suspected of driving the train too fast through a tight curve on the outskirts of the northwestern Spanish city of Santiago de Compostela.

Examining Magistrate Luis Alaez formally charged Garzon with "79 counts of homicide and numerous offences of bodily harm, all of them committed through professional recklessness," the court said in a statement.

In a closed-door hearing before Judge Alaez, Garzon admitted taking the curve too fast, blaming it on a momentary lapse, according to media reports.

Alaez set the following conditions of release: Garzon must check in regularly with the court, surrender his passport and not drive trains.

None of the parties in the case, which include state train operator Renfe, state railway firm Adif and two insurance companies, had asked for Garzon to be jailed pending trial, and he was not seen as a flight risk, the court statement said.

At 8:41 p.m. on Wednesday the eight-carriage, high-speed train slammed into a concrete wall, crumpled, and some of the cars caught fire. The impact was so strong that one of the carriages was thrown several meters high over an embankment.

The death toll from Spain's worst train disaster in decades rose to 79 after one injured person - a woman from the United States - died on Sunday.

Seventy people remain hospitalized with injuries from the crash, 22 are in critical condition.

Garzon has worked for Renfe for 30 years, 10 as a driver. His father also worked on the rails and he grew up in Renfe-owned housing in the northwestern town of Monforte de Lemos and went to school with other train-workers' children.

After the accident he was hospitalized with a head injury. On Saturday he was released from the hospital but remained in police custody until he was taken to the hearing at Santiago de Compostela's main courthouse.

Neither lawyers nor members of Garzon's family could be reached for comment.

Alaez has been assigned to investigate the case and will also look at whether the train, the tracks or the security system that slows down the trains were at fault.

UP TO THE DRIVER
The Alvia train involved in the accident, one of three types of high-speed train services that run in Spain, received a full maintenance check on the morning of the journey, the head of Renfe said, and security systems were in good shape.

"As far as we know, the train was in perfect condition when it set off on its journey," Renfe President Julio Gomez-Pomar told newspaper ABC.

The Alvia trains run both on traditional tracks, where drivers must heed warning systems to reduce speed, and on high-speed tracks where a more sophisticated security system will automatically slow down trains that are going too fast.

At the section of the track where the accident happened, it was up to the driver to respond to prompts to slow down.

Gomez-Pomar rejected criticism that the safety system was insufficient, saying the debate "does not make much sense".

CELEBRATIONS CANCELED
The city of Santiago was meant to be celebrating the yearly festival of St. James on July 25, with thousands of Christian pilgrims arriving after walking the famous Camino de Santiago ancient pilgrimage trail.

A week of concerts and other cultural events were canceled after the train crash on the eve of the festival. On Sunday, black ribbons of mourning hung on the empty stages that had been set up.

Pilgrims, many of them fresh off the trail and carrying backpacks, crammed into a standing-room-only Mass in Santiago's centuries-old cathedral where they were asked to remember the victims of the accident.

At the cathedral gates, along with flowers and candles commemorating the dead, some people left walking sticks from their journeys and others placed shells, the symbol of St. James and badge of honor for the pilgrims who complete the journey.

Prime Minister Mariano Rajoy, who visited the crash site after the tragedy, is due to return on Monday to Santiago, the city where he was born, for an official funeral ceremony for the victims.

Dolores Mato, 57, a shopkeeper who works close to the ancient cathedral, expressed sympathy and grief for the victims and their families, but also for Garzon, who she said had been "crucified" in the media.?

(AP) ? A tour bus filled with Italians returning home after an excursion plunged off a highway into a ravine in southern Italy on Sunday night after it had smashed into several cars that were slowed by heavy traffic, killing at least 37 people, said police and rescuers.

Flashing signs near Avellino, outside Naples, had warned of slowed traffic ahead along a stretch of the A116 autostrada, a major highway crossing southern Italy, before the crash occurred, said highway police and officials, speaking on state radio early Monday. They said the bus driver, for reasons not yet determined, appeared to have lost control of his vehicle.

Hours after the crash, firefighters said that they had extracted 37 bodies ? most of the dead were found inside the mangled bus, which lay on its side , while a few of the victims were pulled out from underneath the wreckage, state radio and the Italian news agency ANSA reported..

The radio report said 11 people were hospitalized with injuries, two of them in very critical condition. It was not immediately known if there were other survivors or any missing.

Rescuers wielding electric saws cut through the twisted metal to better probe the interior of the bus, stopping occasionally in silence to listen for any cries for help, even as the bodies were put into coffins to be taken to a morgue.

Reports said as many as 49 people had been aboard the bus when it ripped through a guardrail after slamming into several cars, then plunged some 30 meters (100 feet) off the highway and into a ravine near a wooded area. In its plunge, the bus tore away whole sections of concrete barriers as well as guardrail. The concrete lay in large chunks in a clearing in a wooded area where the bus landed.

State radio quoted Avellino police as saying the bus driver was among the dead.

Occupants of cars which were hit by the bus stood on the highway near their vehicles. One car's rear was completely crumpled, while another was smashed on its side. It was not immediately known if anyone in those cars had been injured.

The highway links western and eastern Italy across the south.

Early reports said the passengers had spent the day in Puglia, an area near the Adriatic on the east coast famed for religious shrines. But on Monday, a state radio reporter at the scene said authorities told him that the bus had been bringing the passengers home after an outing to a thermal spa area near Benevento, a town not far from Avellino. Others at the scene said the passengers might have visited a town near Benevento that was the early home of Padre Pio, a late mystic monk highly popular among Catholics in Italy.

Passengers came from small towns near Naples, and relatives streamed to the crash site.

The bus dove off the highway near the town of Monteforte Irpino in Irpinia, a largely agricultural area about 40 miles (60 kilometers) inland from Naples and about 250 kilometers (160 miles) south of Rome.

A reporter for Naples daily Il Mattino, Giuseppe Crimaldi, told Sky TG24 TV from the scene that some witnesses told him the bus had been going at a "normal" speed on the downhill stretch of the highway when it suddenly veered and started hitting cars. He said some witnesses thought they heard a noise as if the bus had blown a tire.

A local prosecutor arrived at the crash scene to begin an investigation into the cause of the crash.
