HD Guru recently published an article entitled "Is your TV watching you?" In it, we discussed the fact that new features in Samsung's top 2012 models -- including built-in microphones, HDTV camera, wireless and wired Internet connection, built-in browser with voice to text conversion, face recognition and more -- could be used to collect unprecedented personal information, as well as present a new way for hackers to invade users' lives.

We asked Samsung for a privacy statement prior to publication, but the company did not respond. Now, Samsung has given HD Guru an official comment, and shared two separate privacy policies. In the interest of transparency, here's the complete statement, with our emphasis added on key parts:

Samsung takes all concerns regarding consumer privacy and information security very seriously. In all of our Smart TVs, including our new 2012 LED and Plasma TVs featuring built-in camera and microphone components, Samsung employs industry-standard security safeguards and practices (including data encryption) to secure consumers? personal information and prevent its unauthorized collection or use.

Samsung also ensures consumers have the opportunity to review the terms of the company?s Privacy Policy prior to using Samsung?s Smart TV services. The Privacy Policy can be found at?www.samsung.com/privacy. ?

The camera and microphone are integrated into the TV to provide users with innovative new ways to control the TV. They may also be used for video conference and speech-to-text services offered by third parties, in which case the audio and video data is transmitted to the service providers? servers and does not pass through Samsung servers. Images captured in order to use the facial recognition feature are stored in a secure manner on the owner?s TV only.?

Should the TV owner choose not to use these features, the camera and microphone can be disabled. Users can check if the camera and microphone are activated from the TV?s settings menu. As an added precaution, the camera can be rotated and tucked into the bezel of the TV. Once tucked away, the camera only captures a black image.

Samsung is dedicated to instilling consumer confidence in this matter. Any questions regarding the Privacy Policy or protection of personal information on the TV can be directed to intertv@samsung.com.

Samsung says it does not upload video or voice streams into its servers, though it does sample your voice for speech command. We know third parties such as Skype use encryption for video conferencing, and Samsung says it uses the same "industry standard security" for the "personal information" it transmits.?

We asked Mineola, N.Y. attorney Emouna Matin, who handles privacy cases, to explain what is meant by "personal information," and if would include video and voice samples, along with browser history and TV viewing habits.

"Samsung has to address that more properly," says Matin. Personal information can be limited pedigree information -- name, address, phone number, age, the kind of descriptive information that identifies you as an individual but doesn't say a lot about who you are -- or ?"stronger" information -- your voice, your personal images, websites visited, data that are not traditionally defined as "personal" but say a lot more about you.

Another issue is that Samsung effectively locks you into a privacy agreement before you can even use the Internet-based services of the TV. In part, this agreement reads:

We reserve the right to share all Personal Data and non-Personal Data with any company within the Samsung Electronics group of companies, or with any other company that operates under the Samsung brand. ... Each of the Samsung Group Companies will use your information in accordance with their own independent privacy practices.

The lengthy agreement goes on to say that your data will be carefully guarded and shared only when necessary "in order to pursue our legitimate interests or if we are required to or are permitted to do so by law." While this reads as relatively standard, the definition of "personal information" is, again, not made clear.

As for the "Group Companies" that can receive personal data from a Smart TV, Samsung says it is not every one of the 48 Samsung subsidiaries and joint ventures. For U.S. customers, only Samsung Electronics Co., Ltd. in Korea, Samsung Electronics America and?Samsung SDS (based in both U.S. and Germany) would share the information. For customers in other countries, their local Samsung subsidiary would also share with the Samsung Electronics Co. and SDS, which handles data globally.

It is good to see Samsung disclosing more details of its privacy policy, but the industry still has a way to go before consumers can have a complete understanding of what is at risk when using these new and unprecedented technologies. HD Guru will continue to investigate the Samsung TVs and others, in hopes of learning exactly what these new HDTV eyes and ears are sending out from your home.

In Mexico, the largest number of online transactions is for the purchase of airline tickets and truck (16%), Entertainment (9%) hotel reservations (8%), buy electronics (7%), clothing and accessories 6%. An estimated 68% of operations is performed online via credit card. Also online transfers and deposits in bank branch increased their share 29 and 27% respectively. In addition 13% of operations were closed by other payment options like debit cards and payments intermediated (telephone bill receipts, payment at convenience stores). The direct discounts (75%) and free shipping of the products (53%) were the most commonly used promotions in stores evaluated. Nine out of ten businesses that participated in the study have online catalogs. In December we made the largest number of online operations. Also in the months of May and October recorded high activity. With respect to security measures observed by the businesses that participated in the study, 70% use the mechanism "and password" as the main measure of security. Furthermore, the use of secure sites (https) amounts to 63% of trade. The study was included a section on consumer habits. These are some of the main results: 81% have purchased any goods or services online, half of them in national stores, 70% make online payments services (utilities, 16%, private services, 42%, both 42%), 26% said they had made purchases through any mobile device, highlighting iTunes, 56% of transactions were made via Visa, Mastercard 37% and 7% American Express. Three out of 10 consumers surveyed spent $ 400 to $ 1,000 in each transaction; 6 in 10 consumers making purchases during periods of one month to three months, and increases the number of people who purchase weekly. The survey reveals a growing awareness of the purchaser on the security measures to make online consumption. 87% conducts its operations at sites recognized, or where a recommendation has been received. 56% of respondents said they had not had any problems in their purchases, 63% of respondents reported feeling confident when shopping online, 9% said they feel some kind of distrust. It would be worthwhile in future studies consider the AMIPCI surveying non-users of Internet, questioning them on suspicion that they have to make purchases online. If among consumers who were surveyed in the recent study, 9% said they feel some kind of mistrust among non-Internet users, of course, the suspicion must be much greater. New police video casts doubt on George Zimmerman injuries

George Zimmerman appears uninjured in a police video taken after the fatal shooting of Trayvon Martin. Zimmerman's attorney said that his client had a broken nose and an injury to the back of his head.

A security video that shows neighborhood watch captain George Zimmerman being led in handcuffs from a police car after he fatally shot Trayvon Martin is adding to the debate over whether the shooting was a case of self-defense.

Skip to next paragraph A Sanford, Fla., police video shows George Zimmerman, apparently uninjured, a few hours he was taken into custody following the Feb. 26, 2012 fatal shooting of teenager Trayvon Martin.

An attorney for the teen's family said it looks to him that Zimmerman doesn't have injuries to his face and head in the video as Zimmerman's supporters have described.

Zimmerman told police he fired in self-defense and he was not arrested, touching off widespread public outrage and protests across the country. Zimmerman's attorney, Craig Sonner, has said in more than one interview that his client's nose was broken during the fight with Martin.

Sanford police Sgt. David Morgenstern on Wednesday confirmed that the video being shown by ABC News is of Zimmerman. The 28-year-old's head and face are visible throughout and he is dressed in a red and black fleece jacket. Police are shown frisking Zimmerman whose hands were handcuffed behind his back. They then lead him into a police station.

"This certainly doesn't look like a man who police said had his nose broken and his head repeatedly smashed into the sidewalk," Ben Crump, an attorney for Martin's family, said in a statement. "George Zimmerman has no apparent injuries in this video, which dramatically contradicts his version of the events of February 26."

Zimmerman said that on Feb. 26, he was pursuing the 17-year-old Martin, who was not armed, because the teen was acting suspiciously. He said he lost sight of the black teenager and Martin attacked him as he headed back to his sport utility vehicle. Zimmerman's father is white and his mother is Hispanic.

In an interview with Orlando station WOFL FOX 35 that aired Wednesday night, Zimmerman's father, Robert Zimmerman, said that despite dispatchers telling his son to stop following Martin, he kept going so he could get an address for police to check. He said his son was suspicious because of several break-ins and thought it was strange for someone to be walking between the town homes on a rainy night.

The Orlando Sentinel, citing anonymous sources, has reported that Martin grabbed Zimmerman's head and banged it several times against the sidewalk. A statement from Sanford police said the newspaper's story was "consistent" with evidence turned over to prosecutors.

Sonner said the gash on the back of Zimmerman's head probably was serious enough for stitches, but he waited too long for treatment so the wound was already healing. Miguel Meza, who identified himself as Zimmerman's cousin, said Zimmerman was in "the fight of his life."

Sonner did not immediately return an after-hours call to his office Wednesday.

Crump called the video "riveting" and "icing on the cake" that Zimmerman should be held accountable for what happened.

Since the shooting, Zimmerman's supporters say he's gone into hiding and that he and his family have gotten death threats.

Martin's supporters, including a host of outspoken celebrities and civil rights leaders who have appeared on television for the past two weeks, don't believe Zimmerman's story. They want him arrested and prosecuted.

SAN DIEGO -- The decisions counties are making right now about how to implement realignment will have dramatic and long-lasting impacts on public safety and on local taxpayers. In a new 100-page report, Public Safety Realignment: California at a Crossroads, the ACLU of California finds that many counties have yet to embrace a central charge of the realignment legislation: to implement evidence-based practices, including alternatives to incarceration, that are proven to prevent crime, limit future victims and stem the flow of people who cycle through our jails and prisons.

The new report, which is based on an in-depth review of all 53 available county realignment implementation plans, finds massive new investment in jails with much less funding allocated to proven crime-prevention programs such as mental health services and drug treatment.

?Simply building new jails or re-opening unused jail space treats the symptom but not the underlying disease,? said Margaret Dooley-Sammuli, Senior Policy Advocate of the Criminal Justice and Drug Policy Project of the ACLU of California and co-author of the report. ?It?s time to confront the fact that in California, over-incarceration is itself a disease, and the way to end it is to expand the use of mental health services, drug treatment and job training, and to reserve prison and jail for responding to serious crimes.?

Central to the ACLU?s analysis is the stunning fact that most people in county jails have not been convicted of a crime. More than 71 percent of the 71,000 Californians held in county jails on any given day are awaiting their day in court. Most of them do not pose a risk to public safety but are stuck behind bars because they simply cannot afford bail.

And while much of the conversation about realignment has focused on jail overcrowding, the ACLU argues that counties can significantly lessen the problem by adopting a pre-trial assessment tool to identify individuals who can be safely released on their own recognizance.

The report also finds:

? a promising commitment?though not yet realized?by many counties to adopt alternatives to incarceration and evidence-based practices to reduce recidivism;
? a troubling lack of state monitoring, data collection, outcome measurements and funding incentives to help counties successfully implement realignment; and
? paradoxically, under the current funding formula, a financial reward for counties that have historically incarcerated more people for low-level offenses.

California at a Crossroads offers recommendations for making the criminal justice system more effective ? and more cost effective.

The report also presents county-by-county profiles of the spending priorities established in the 25 counties that have initially received the most AB 109 dollars?nearly $400 million, slated to grow to more than $1 billion annually in the next fiscal year.

The 25 county profiles also contain a summary of jail expansion plans and notable efforts to expand the use of alternatives to incarceration.

Solar tariff loss for government

The government has failed to get permission to appeal to the Supreme Court over its plan to cut subsidies for solar panels on homes.

The UK's highest court said it could not challenge a High Court ruling that blocked the halving of payments to households generating solar energy.

Critics argued the plan to bring the lower rate in in December was too short notice and lacked proper consultation.

The lower tariff will now apply to panels installed after 1 April.

Campaigners argued that the plans had caused huge uncertainty in the industry, which employs tens of thousands of people.

Friends of the Earth's executive director Andy Atkins described the ruling as "a landmark decision which will prevent ministers causing industry chaos with similar subsidy cuts in future".

The government said the court's decision drew a line under the case.

"We will now focus all our efforts on ensuring the future stability and cost effectiveness of solar and other microgeneration technologies for the many, not the few," said Energy and Climate Change Secretary Ed Davey.

What the ruling means

Anybody who had a domestic solar scheme finished before 12 December 2011 gets the old rate of 43.3p per kilowatt hour for the full 25 years of the scheme. That was not at issue in this case.

Now that the government has lost its appeal, anyone who had a scheme finished between 12 December 2011 and 2 March 2012 will also still get the full 43.3p/kwh for the whole 25 years of their scheme.

Installations finished between 3 March and 31 March temporarily get the old higher rate until 1 April when it is reduced to 21p/kwh.

Schemes finished after 1 April will only get the reduced rate of 21p/ kwh.

Under the feed-in tariffs programme, people in the UK with solar panels are paid for the electricity they generate.

The new tariff of 21p per kilowatt hour, down from the current 43.3p/kwh, had been expected to come into effect for panels finished after 1 April, but in October the government said it would be paid to anyone who installed their solar panels after 12 December 2011.

The government announced a consultation on the proposals which closed on 23 December.

The High Court ruled that changing the tariffs before the end of an official consultation period was "legally flawed".

Upholding that ruling, the Supreme Court said the government's appeal "does not raise an arguable point of law of general public importance which ought to be considered by the Supreme Court at this time".

The court's decision now means that all domestic installations finished before 3 March this year will still get the higher 43.3p rate.

Installations finished between 3 March and 31 March temporarily get the old higher rate until 1 April then it is reduced to 21p.

The legal challenge was initiated by Friends of the Earth and two solar firms, Solarcentury and HomeSun.

Caroline Flint MP, Labour's shadow energy and climate change secretary, said: "Today's ruling proves, once and for all, that the government's cuts to solar power are not just bad for the public, bad for jobs and growth, and bad for the environment, but unlawful."

The death of the American Chestnut due to an Asian bark fungus accidentally introduced to the United States had profound environmental and economic consequences since the tree was highly valued for its strong, workable lumber and a variety of wildlife from deer to birds to bears relied upon the chestnut for food.

Ongoing efforts to reintroduce the American Chestnut are labor intensive and expensive, in part because they rely on genetic cross breeding to produce a tree that is genetically speaking primarily an American Chestnut but endowed with the Chinese Chestnut blight-resistance genes. For instance, one recent blight-resistant strain ready for reintroduction is calculated to be 94 percent American Chestnut and six percent Chinese Chestnut.

Since production of genetically cross-bred American Chestnuts for reintroduction is so laborious, University of Cincinnati graduate and undergraduate biology students recently tested a new software tool called NEWGARDEN in order to see how it might guide preserve managers in creating the most-favorable conditions for reintroduction plantings of American Chestnuts.

The results of that testing, "Founder Placement and Gene Dispersal Affect Population Growth and Genetic Diversity in Restoration Planting of American Chestnut," will be presented by UC biology doctoral student Yamini Kashimshetty at the March 23-25 Midwest Ecology and Evolution Conference, a conference specifically for undergraduate and graduate student research that will draw representatives from the region.

Several years ago, UC faculty members Steven Rogstad of biological sciences and and Stephan Pelikan of mathematical sciences developed the NEWGARDEN computer program in order to not only track but to predict long-term outcomes for newly founded plant populations in terms of population size and genetic diversity.

Predicting best planting practices for American chestnuts

Using the NEWGARDEN software, UC students Kashimshetty and Melanie Simkins input a variety of founder planting scenarios in order to determine which would best promote a reintroduction population of American Chestnuts to thrive for the next 101 years.

They began with a theoretical restoration preserve of about 25 square kilometers square (or about 9.7 square miles). Using the software, they varied the original placement of 169 founder American Chestnuts to determine which pattern would theoretically lead to the largest population gains and the greatest genetic diversity among that population for the next 101 years. (An original replanting of 169 trees was selected for this study because previously published studies determined that figure to be the minimum number required to retain a high level of long-term genetic diversity while keeping reintroduction expenses at a minimum.)

Said Kashimshetty, "Due to the expense of producing the hybridized American Chestnuts, we wanted to test and determine potential best practices for reintroducing them. The tests that we are able to do virtually, such as varying different life history characteristics - including pollen and offspring-dispersal distances or varying the placement geometry of founders, cannot be easily done in the real world since large areas, large numbers of trees and replicate experiments lasting 100 years or more would be needed."

So, she added, "To perform multiple real-world variations on a tree like the American Chestnut would be extremely expensive and labor-intensive."

In testing varying reintroduction scenarios with the NEWGARDEN software, the UC team simulated natural population development and found

• At least 9,000 resulting trees would be possible in 101 years' time by moderate dispersal (manually moving) of offspring seeds or seedlings to greater distances from the founders than would occur naturally.
• If the original stand of trees is planted at the edge of the preserve, it's estimated that the original stand of 169 trees would result in approximately 2,000 resulting trees in 101 years' time. Thus, by planting the trees further into a preserve at 1,500 meters, with proper spacing, it's estimated that 247 percent more trees will result in 101 years' time.
• Even planting the founder trees only 500 meters (1,640 feet) into the preserve vs. planting founders on the preserve's edge would increase the population size by 148 percent in 101 years' time.
