Police blotter: Chad Mendes charged, former Jackson?s fighter arrested

Police-related news in MMA to report:

-- UFC featherweight Chad Mendes was charged with simple battery for his role in a bar fight in Hanford, Calif. He is cooperating with the police, denies he was involved, and will be arraigned on Sept. 19. Mendes' last fight was a 31-second knockout of Cody McKenzie at UFC 148.

-- Willie Parks, a featherweight who once trained at Jackson's MMA and helped with their wrestling, is facing aggravated assault charges and was arrested by U.S. Marshals after allegedly beating his girlfriend so badly that she miscarried.

Officials from Jackson's MMA said they severed ties with Parks months ago. His last fight was a win in March.

As the Northwest Passage becomes increasingly ice-free during the summers, Cambridge Bay, Nunavut, has seen a dramatic upswing in tourists arriving by sea.

?It wouldn?t be surprising to see six sailboats out in the bay at one time, and we usually have between two to six cruise ships come here every year as well, and the cruise ships have hundreds of tourists,? said Cambridge Bay?s senior administrative officer Steve King.

The first cruise ship successfully crossed the Northwest Passage in 1984, but it wasn?t until the 1990s that the ships began to pass through every year. Sailing the Northwest Passage in private yachts took off in the 2000s.

For the last five years, the passage has been nearly ice-free in the late summer, according to Environment Canada data.

Vicki Aitaok, Cambridge Bay?s cruise ship co-ordinator, said the community?s visitors? centre logged a 30 per cent increase in numbers of tourists over the past five years.

According to a visitors exit survey commissioned by Nunavut?s Department of Economic Development and Transportation, close to 3,000 cruise ship passengers visited the territory in 2008, making up 12 per cent of total visitors. In 2011, 16 sailboats or yachts made their way into Northwest Passage.

Those who travel the passage say they feel the history of the place, as 19th Century explorers travelled the same waters.

?I like it when people say ?oh it?s easy now what you?re doing because all the ice is gone,?? said Frank Rothwell, skipper of the Upchuck, a sailboat from England stopping over in Cambridge Bay on its way through the Passage. ?And I say ?hundreds of men died trying to do what we?re doing now.??

Modern technology may add some security and comfort ? the Upchuck is equipped with a satellite phone and heat ? but a long voyage in a remote area requires being self-sufficient in food, fuel, tools and parts.

Long weeks spent in communities like Cambridge Bay waiting for ice to clear also fosters camaraderie among the sailors of international origin.

?At the moment, we?ve got quite a few tourists in and we were even joking at breakfast this morning that we can find a quieter place at home and we?ve come all the way to the Arctic and it?s so busy,? said Huw Fernie, a member of the Upchuck?s crew.

Charts not reliable

Navigating the Northwest Passage is not all smooth sailing. Charts are not as reliable as they are in more travelled waters.

In 2010, the MV Clipper Adventurer ran aground on an uncharted rock in the Coronation Gulf on its way to Kugluktuk. Its 118 passengers had to be ferried to shore by a Canadian Coast Guard icebreaker, which was luckily not too far away.

Similar incidents happened in the region in 1996 and in 2007.

Rescue is often not close by, either. Search and rescue aircraft are all located thousands of kilometres away ? in British Columbia, Nova Scotia and Ontario.

Peter Garden, a tourist from New Zealand who is sailing the passage with his family, said he is used to charts not being accurate in places such as the South Pacific, where they can be off by up to two miles.

?It?s nothing like that here but the errors are significant ? they can be a quarter of a mile and if you?re navigating in a narrow passage with rocks around you have to always assume that there can be unknown dangers,? said Garden.

?The charts tend to be accurate, they?re just not aligned correctly to where they should be. They need to be moved up or down, east or west, a little bit.?

Rothwell said sailing the Arctic is not for amateurs.

?Anybody that?s coming up here in a yacht is not a first time sailor,? he said.

Some towns not well-equipped for tourists

There?s also a lack of amenities for visitors in a territory where tourism is still a fledgling industry.

The 2008 visitors? exit survey found that more than half of Nunavut?s yearly visitors were travelling for business, not leisure. The high cost of travel in the North continues to be a common complaint. In the survey, only 41 per cent of visitors to Nunavut said they felt their trip was good value for the money spent.

The sailors all agreed Cambridge Bay is well equipped for tourists compared to some of the places they had been in the North.

?[In Tuktoyaktuk, N.W.T.,] we found it impossible to find an internet connection, certainly nowhere to do your laundry,? said Garden.

?They invited us to the community hall where they had drum dancing and so on and we had a great time there. But if you flew in as a tourist expecting an amazing sort of northern experience you might find it difficult to find things to occupy yourself.?

Taking advantage of growing interest in the North

Aitaok said when the cruise ships first started arriving in Cambridge Bay, she noticed the visitors ?sort of wandered around town in these red coats?.

Now the hamlet offers cruise companies an extensive cultural program and paid guides take the visitors around town.

?[They] take groups of 10 to 15 people and they talk about everything, from the water and sewage truck delivery, to the gravel roads, to why the houses are on stilts, to the Bay Maud out in the bay and the history of the LORAN tower,? she said, referring to the town?s Long Range Navigation tower that has been there since the late 1940s.

If Cambridge Bay were to accommodate more visitors, Aitaok and King say infrastructure improvements are needed. King points to a need for more hotels and restaurants, and Aitaok said a longer, paved runway would allow larger planes to land, lowering costs for passengers and freight.

?The cost to get here is probably the biggest barrier,? said Aitaok. ?Any way that that could be reduced we would see certainly a lot more people coming.?

?Everything that we do, that we take for granted here in our day-to-day, is seen by so many other people as just ?wow?, unusual. People in the community are starting to recognize that, and are very proud of it.?

Could Paul Ryan's small business ties aid the GOP? | The Salt Lake ...

When small business owners vote in the presidential election in November, one factor in their choice may be Paul Ryan?s ties to a small company, the construction firm in Janesville, whose roots go back to the business his great-grandfather started in 1884.

On his way to becoming a congressman from his hometown of Janesville, Wis., Paul Ryan worked in a small business ? a construction company with roots that reach back to the firm that his great-grandfather started in 1884.

Although the future GOP vice presidential candidate worked at Ryan Inc. Central doing marketing for just a short time ? from 1997-98 ? that experience may help the Romney-Ryan ticket. The obstacles that small businesses face hiring more workers are among the biggest issues in this presidential election. The perception that Ryan understands their problems could bring in votes ? even though he was chosen largely because of his conservative stance on federal spending.

"I always appreciate folks who have spent time in the real world," says Nick Balletta, CEO of TalkPoint, a New York firm that runs online broadcasts for businesses. "In the real world, there?s payroll that needs to be made, bills that need to be paid and customers that need to be satisfied."

The GOP might convince business owners that despite the brevity of Ryan?s time at the company that "it was a valid experience and he would be more likely to understand their situation," says Trey Grayson, director of Harvard University?s Institute of Politics. He also may appeal to independent voters including small business owners in parts of states like Wisconsin, Florida, Nevada, Illinois and Michigan that have struggled more than other areas of the country, says David McCuan, a political science professor at Sonoma State University in Rohnert Park, Calif.

"Ryan helps at some level in certain states," he says. "It?s an open question of whether he helps in the big picture."

Both Ryan and Vice President Joe Biden have spent almost all their working lives in politics. Biden was elected to the New Castle, Del., County Council shortly before he turned 27 and to the Senate when he was nearly 30. Ryan was 28 when he was elected to Congress. Biden?s resume doesn?t include time at a small business, but he talks about the financial struggles of his father, who lost money in business ventures, had to move in with Biden?s grandfather and had jobs that included cleaning boilers and managing a car dealership. That has helped voters identify with his middle-class childhood, McCuan says.

"Biden does a really good job of connecting with the common working person" and that appeals to small business owners, he says.

Ryan has that quality as well, and "brings that everyman kind of pitch" to the GOP ticket, McCuan says. That can mitigate the feeling among voters that Romney can?t connect with people, he says. But, he adds, both candidates look like a regular guy, someone you?d want to have a beer with.

Biden?s experience as vice president is more relevant than his resume.? "No matter what the background of Joe Biden was before, that trumps everything else," Grayson says. ?

Nonetheless, Ryan?s small business ties will likely come up during the campaign.

Ryan Inc.?s operations include excavation and building site preparation for commercial and residential construction. It also builds golf courses and creates wetlands. Although it?s based in Janesville, much of its work is done elsewhere ? it has offices in Elgin, Ill., and Hagerstown, Md., and has worked on projects across the Midwest, Northeast and Southeast.

"What we do is move piles of dirt from one place to another" using equipment like bulldozers, says Adam Ryan, company president and Paul Ryan?s cousin. Their grandfathers were brothers.

The company has between 100 and 125 full-time employees at its three locations and during the construction season, that number rises to between 300 and 500 workers, Adam Ryan says. Ryan Inc. is small enough that it doesn?t make the list of the 40 biggest employers in Rock County, where Janesville is located. But the business is highly regarded in the city of nearly 64,000 because of the connection to the Ryan family, says Vic Grassman, Janesville?s director of economic development.

The cousins went to high school together but didn?t work together at Ryan Inc. Adam joined the firm after Paul was elected to Congress. Paul Ryan, who earned less than $30,000 at Ryan Inc., helped the company "figure out what kind of work we should be pursuing," Adam says.

"My recollection is that it did lead to projects for us," Adam says. Neither he nor the Romney campaign could provide specifics. Paul Ryan doesn?t have an ownership stake in the company, according to his cousin and the campaign.

Like other Republican lawmakers, Paul Ryan has called for the repeal of the health care law that the Supreme Court upheld in June. He?s critical of government spending and regulations created under the Obama administration. Although Ryan and Romney have campaigned on issues like health care and regulations that affect small companies, Adam Ryan says his biggest concern as a small business owner is getting more sales in a construction environment that remains weak following the recession.

Visit to Comrie, Scotland ? Wendy LeBlanc

From August 16 to 20th, Jeff Maguire, chair of the Sister City Committee, his wife, Kathy, and my husband, Frank, and I visited Comrie, Scotland to mark the 20th Anniversary of the twinning of Carleton Place with that community.? It was a wonderful trip where we had many opportunities to renew old friendships, look back on the past, and forward to the future.? Below are two speeches that I gave during two of the Commemorative Ceremonies:

20th Anniversary Commemorative Dinner

I am delighted to be here today as part of the Carleton Place Sister City Committee as we commemorate the 20th anniversary of the twinning of our two communities.? Marking special anniversaries such as this one, gives us an opportunity to look back at what has been accomplished over the 20 years as well as occasion to look ahead to the future.

It was during the 1980s that author Peter McNaughton, a native of Comrie living in Montreal, discovered the historical connections between the two communities. Many of the first settlers in the Carleton Place and Beckwith Township area came from Perthshire. Visitors to the United Cemeteries just outside of Carleton Place often remark on the number of Scottish settlers buried there.

When the idea of twinning was raised with the two communities, the Comrie community council was immediately won over because of the historical association. Comrie Council chair, Sandy Grey, along with Jimmie Stewart and Jim McEwan, leader of your local pipe band, and Melba Barker, mayor of Carleton Place, were instrumental in developing the twinning plan.

On August 1, 1992, ceremonies held here on the Ross Bridge over the River Earn and in St James Park on the banks of the Mississippi River formalized the twinning between Comrie and Carleton Place.

Since that time, two official group visits from Comrie took place in 1994 and 1997, both led by members of the Comrie Pipe Band.? Ron and Barb Goebel brought four official visits from Carleton Place between 1996 and 2002. George, Marlyn and Amanada Lees have visited Carleton Place a number of times and in 2005 they took part in a ceremony to unveil a sign featuring the twinning arrangement between the two communities, located at the Trans Canada Trail entrance.? Modern technology linked the two communities for the 15th Anniversary celebrations on July 28, 2007 with celebrations in each location being viewed in the twin community.? 2010 marked the first student exchange between young people of Comrie and Carleton Place; this was a wonderfully successful event with lifelong friendships being established.

Private, unofficial visits have also taken place to each of the communities, and friendships flourish through these visits, emails, letters, and telephone calls, and strengthen the twinning relationship.

Carleton Place has benefited in many ways by the twinning, but perhaps one of the most obvious is the beautification of the town that has taken place since the Carleton Place in Bloom committee was formed.? Following a visit to Comrie when it was named Scotland?s Prettiest Village, Mayor Brian Costello formed the group that has worked for the past 15 years to beautify the community, and we reached the much sought-after 5 bloom rating after a number of years of concentrated effort ? all thanks to Comrie!

This visit to Comrie is just one of several ways we are marking this significant anniversary.? On Saturday, September 29, the Sister City Committee is holding the annual heritage Ball with this year?s theme being a Highland Fling, and hosted by a delightful Scottish couple who emigrated to Canada and Carleton Place a number of years ago. We are pleased that the Lees family is able to join us for this special occasion.? Indeed there will be a little more of Comrie at the event as well as all the attendees will be photographed with? an 8 foot square photo of the White Church in the background.

Dear friends, it has been a pleasure to have been associated with you for the past 20 years and we look forward to many more years of rewarding relationships between the two communities.

20th Anniversary of Twinning

It gives me great pleasure to be back in Comrie once again.? This is Frank?s and my second trip and for the Maguires their fourth visit to this community.? Last time we were here marked the first student exchange. We?ve had a 15th anniversary celebration in 2007 and now here we are at our 20th.? Lots of firsts over the years, but more importantly seconds, fifths, tenths, and fifteenths.? Those past anniversaries, and the one this year, our twentieth, show that the twinning has worked, that there are groups and individuals who are dedicated to keeping the bonds alive and building on what has been accomplished in the past, so that there will be a future where we can look forward to a second and third student exchange, a twenty-fifth anniversary, and many return visits by private individuals and groups between Comrie and Carleton Place.? We are delighted to be here to represent our community, to enjoy your Highland hospitality, and to begin another decade of a positive, mutually-beneficial relationship.

Feds Are Cutting Social Security Benefits From ... - Business Insider

While most attention in the ongoing student debt crisis narrative has focused on new graduates, it turns out the federal government has been quietly targeting a different group of debtors: retirees.?

The Treasury Department has been withholding as much as 15 percent of Social Security benefits from "a rapidly growing number of Social Security recipients who have fallen behind on federal student loans," Smart Money's Annamaria Andriotis reports:

"From January through August 6, the government reduced the size of roughly 115,000 retirees' Social Security checks on those grounds. That's nearly double the pace of the department's enforcement in 2011; it's up from around 60,000 cases in all of 2007 and just 6 cases in 2000...

The amount that the government withholds varies widely, though it runs up to 15%. Assuming the average monthly Social Security benefit for a retired worker of $1,234, that could mean a monthly haircut of almost $190."

Since 2001, the number of retirees who've seen benefits garnished has ballooned from about 20,000 to nearly 100,000. The worst part? Some of these retirees are simply among the growing number of older consumers who've taken on loans to help their kids or grandchildren through college.

A recent report by the New York Federal Reserve found more than 17 percent of student loan borrowers are over the age of 50.?

And while slates for credit and other forms of debt can be wiped clean in bankruptcy, lawmakers have yet to add student loan debt to the list.?

Still, simply owning study loans in old age doesn't automatically put retiree's benefits on the fed's chopping block.?

"It's when people aren't making any attempt whatsoever [to pay] that they start heading down that road," said Justin Hamilton, spokesman for the Dept. of Education.

State quietly dropped violations and fine in workplace death

Around midnight on June 1, 2007, Tina Hall was finishing her shift in a place she loathed: the mixing room at the Toyo Automotive Parts factory in Franklin, Ky., where flammable chemicals were kept in open containers.

A spark ignited vapors given off by toluene, a solvent Hall was transferring from a 55-gallon drum to a hard plastic bin. A flash fire engulfed the 39-year-old team leader, causing third-degree burns over 90 percent of her body. She died 11 days later.

After investigating the accident, the Kentucky Labor Cabinet?s Department of Workplace Standards cited Toyo for 16 ?serious? violations and proposed a $105,500 fine in November 2007.

?You?re disappointed because you think, that?s all they got fined?? Hall?s sister, Amy Harville, of Moulton, Ala., said in a telephone interview. ?But then I thought, at least they got 16 violations. I was thinking they?d stick, as severely as she was burned.?


The violations didn?t stick. Every one of them went away in 2008, as did the fine, after Toyo?s lawyer vowed to contest the enforcement action in court. Last month, in a move believed to be unprecedented in Kentucky, the Department of Workplace Standards reinstated all the violations because, it said, the company hadn?t made promised safety improvements.

The case was another black eye for state-run workplace health and safety programs nationwide. In all, 26 states administer their own programs under federal supervision. Several have been criticized in recent years for capitulating to lawyered-up employers, performing subpar inspections and shutting out accident victims? families.

Officials in Kentucky didn?t tell Harville and Hall?s husband that the Toyo violations had been dismissed. They found out in 2010 only because Ron Hayes, a fellow Alabamian who runs a nonprofit advocacy group for families of fallen workers, had taken an interest in the case and checked in regularly with the Department of Workplace Standards.

Hayes ? whose son, Pat, died in a Florida grain elevator accident in 1993 ? lodged a formal complaint against Kentucky with the U.S. Department of Labor?s Occupational Safety and Health Administration, which concluded in June 2011 that the state had erred.

?Deleting citations in their entirety sends a signal to employers that they need only contest to alleviate the burden of history,? OSHA?s regional administrator in Atlanta, Cindy Coe, wrote to Hayes.

In a written statement, Kentucky?s Department of Workplace Standards said it dismissed the violations after determining that ?the case would not have withstood legal challenge.? Instead, the department and Toyo entered into a settlement agreement, which provided for follow-up inspections. Toyo?s alleged failure to meet the terms of that agreement led to the reinstatement of the violations last month.

The reinstatement showed that the violations never should have been dropped in the first place, Hayes said. ?It?s vindication, because we said all along this was wrong,? he said.

The president of Toyo Automotive Parts did not return calls seeking comment. In a 2008 legal filing, Toyo denied responsibility for Tina Hall?s death, calling the accident ?the result of unforeseeable, isolated acts undertaken by an individual employee.?

Problems in the states
Under the Occupational Safety and Health Act of 1970, states that choose to regulate workplace health and safety must ensure that their programs are ?at least as effective? as the federal one. OSHA pays up to half the cost of such programs and is supposed to keep tabs on them.

By some accounts, it hasn?t done a particularly good job. After press reports about a rash of construction worker deaths in Las Vegas, OSHA reviewed the Nevada program in 2009 and found a long list of flaws. Among them: State inspectors weren?t sufficiently trained to identify construction hazards and were discouraged by managers from issuing ?willful? violations ? which suggest an employer showed ?plain indifference to the law? and can lead to stiff penalties ? to avoid protracted court battles.

OSHA looked at the programs in the 25 other states that administer their own, finding deficiencies such as uncollected penalties in North Carolina and misclassified violations in South Carolina. Kentucky, OSHA found, was taking too long to issue citations and wasn?t making complainants aware of ?specific official findings.?

In 2011, the Labor Department?s inspector general reported that OSHA hadn?t found a suitable way to measure the effectiveness of state programs. In his response to the IG, OSHA chief David Michaels wrote that the agency was developing a new monitoring system that would involve, among other things, reviews of state enforcement case files.

Still, Hayes believes that ?systemic problems? persist. ?Oversight from federal OSHA has been lacking for the past 42 years,? he said. ?There are so many different problems from state to state.?

Indeed, Hawaii?s program ? described as ?poor? in a 2010 OSHA report ? has been severely hampered by budget and staffing cuts for the past three years. Things got so bad that state officials recently asked the federal government for help.

?The Five Commitments??
In its 2007 annual report, Toyo Tire & Rubber Co., a Japanese conglomerate that makes tires, auto parts and chemicals in plants around the world, lists what it calls ?The Five Commitments.?

?We make safety our highest priority in the provision of products and services,? reads Commitment No. 2.

Tina Hall thought otherwise, according to her husband. At the time of the accident in June 2007, she was trying to transfer out of the Franklin plant?s adhesive department because the job required her to spend time in the mixing room, where toxic and flammable chemicals were stored.

?She talked about how bad the fumes were in that room,? said L.V. Hall, who lives in Bremen, Ala. ?She said something about the disposal of chemicals ? they weren?t doing it right. I?d been wanting her to get out of that mess.?

Tina Hall and other team leaders would go into the mixing room to fill plastic bins, known as totes, with solvents such as toluene. They?d clean gummed-up machine fixtures in the totes. Team leaders also would fill five-gallon buckets with solvents and carry them to adhesive machines on the factory floor. The solvents were used to take residue off the machines.

Kentucky?s Department of Workplace Standards would later cite Toyo for obstructing exit routes in the mixing room, not keeping flammable liquids in covered containers when they weren?t being used, failing to control vapors and having inadequate fire-protection equipment.

On the night of the accident, Tina Hall was cleaning fixtures by herself when a spark, likely caused by static electricity, ignited toluene vapors and set off an explosion in a 55-gallon drum of methyl isobutyl ketone, another solvent.

Then a General Motors assembly line worker, L.V. Hall was awakened at home in Auburn, Ky., by a call from a Toyo team leader around midnight. His wife, on fire, had managed to get outside and roll on the ground. ?How she got outside I don?t know,? Hall said. ?It was like an obstacle course to find the exit door.?

Tina Hall was taken to a local hospital, then to Vanderbilt University Medical Center in Nashville, about 45 minutes away. L.V. had a brief talk with her before the doctors put her into a coma to shield her from the pain. ?She said, ?I did everything the way I was supposed to do it,?? Hall said. His wife drifted off and never regained consciousness. She died on June 12, 2007.

'Travesty of justice'
Not long afterward Tina Hall?s younger sister, Amy Harville, was directed to Ron Hayes by an acquaintance. Burly, white-bearded and tenacious, Hayes lives in Fairhope, Ala., and runs the FIGHT Project, which helps families navigate the bureaucracy of workplace fatality investigations. Hayes counseled Harville and L.V. Hall as the state?s inquiry into the Toyo accident progressed.

When the Department of Workplace Standards issued 16 serious violations against the company in November 2007, ?I was OK with it,? L.V. Hall said. ?I didn?t realize that once that?s done, these attorneys can get in there and just do away with it.?

Documents obtained by the Center for Public Integrity under the Freedom of Information Act show how Toyo?s lawyer, Mark Dreux of Arent Fox in Washington, D.C., fought the state of Kentucky from the beginning. Dreux declined to comment on the case.

In March 2008, the state offered to reduce the penalty from $105,500 to $74,000. Dreux refused. In June 2008, the state proposed a further reduction, to $15,000, for three violations. Dreux said no. In November 2008, Dreux got what he wanted: No violations and no fine.

It was Hayes who first learned, in July 2010, that all the violations had been deleted. He alerted Harville.

?I was devastated,? she said. ?It takes you back all over again, like Tina was killed for the second time.?

She called L.V. Hall, who reacted similarly. ?I was just shaking I was so upset,? he said. He called the Department of Workplace Standards and finally reached ?the lady attorney who was over the case. I basically told her, ?I cannot believe y?all dropped every one of those citations.? She said, ?Well, Mr. Hall, I am an attorney and there was not enough evidence.??

Hayes knew what to do. He filed a CASPA ? Complaint About State Program Administration ? with OSHA?s Atlanta regional office, calling Kentucky?s dismissal of the citations a ?travesty of justice.?

After an investigation, Regional Administrator Cindy Coe, in essence, agreed, writing in June of last year that ?the violations were well documented and legally sufficient and there was no definitive evidence in the file that indicated that they could not be supported.? Deleting all the citations, Coe wrote, erases an employer?s safety history and deprives regulators of critical information should subsequent enforcement actions commence.

?It also signals to compliance staff that their efforts are for no good end, if the point is to drop everything at the threat of going to court,? the administrator wrote. ?It further signals to employees in the workplace that there is no entity on their side.?

In his response to Coe, the commissioner of the Kentucky Labor Cabinet, Michael Dixon, wrote that the state ?does not retreat from litigation? but didn?t believe it could defend the case before the Kentucky Occupational Safety and Health Review Commission, an appeal body.

In May, a state inspector returned to the Toyo plant in Franklin to see if the company had done all the things it said it would do after Tina Hall?s death ? making sure supervisors were trained in the correct way to clean fixtures, for example. It hadn?t.

In a July 5 letter, Susan Draper, then director of the Kentucky Labor Cabinet?s Division of Occupational Safety and Health Compliance, notified Ronald Wyans, president of Toyo Automotive Parts (USA), that the 16 original citations had been reinstated, as had the proposed $105,500 penalty. The Tina Hall case had come full circle.

Sometime in the next few weeks, Amy Harville, L.V. Hall and Hall?s lawyers expect to meet with Dixon and Toyo counsel. They expect to learn whether Toyo intends to accept its punishment or continue fighting.
